My daughter was dismissed

My daughter was just shy of 12 months working part time in her job. This weekend she went in to work when 20 minutes later the Boss's second in command called her out the back and handed her a dismissal letter told her the boss asked to give it to her and claimed he had no idea why she was being dismissed. It was a shock because she had received no verbal or written warning leading up to this. She is distraught as a result. Im not concerned about her no longer working there as her boss is a toxic man and reviews online reveal this also. I am worried how this will effect her getting another job especially as she was fired after a year and not say 2 months! She rang him last night after she stopped crying but he didn't ansand text her to email him after the weekend. Im so angry I am trying to contain myself but surely at least morally speaking this is so wong?

An employer is free to terminate workers within 12 months without having to provide cause, as long as they follow proper procedures.

What’s interesting about the letter is that it refers to “disciplinary action”, even though the decision to terminate seems to be for reason of unsuitability.

If termination was a disciplinary action, there should previously have been a disciplinary process comprising a formal communication of the alleged misbehaviour, an investigation, a subsequent decision to invoke the company’s disciplinary procedure (which every employer is required to have and to make known to employees), an opportunity for the employee to give their side of the story etc.

Then, and only then, could there be a decision to terminate.

I think your daughter would have reasonable grounds to make a complaint to the WRC on the company’s failure to apply proper procedures. Unfortunately, she’s not there long enough to claim unfair dismissal.

Really, so how many times have you done this and how many times have had the nice solicitor's letter sent to you, or perhaps if the boss is particularly PO with you a criminal compalin. Best ignore this kind of nonsense, because it can make a bad situation a lot worse.

It was something like "My daughter was dismissed from her job" but then the thread-starter didn't like some responses (a few were out of line, accusing her of being on a wind-up, but most were genuine advice) so asked on-thread for the thread to be removed. Then because you have to message a moderator to do this, I suppose the OP changed the title herself - but I didn't see trolling, just some negative replies.

That's my take on it, the letter clearly says she was fired for not being able to do the job or a disciplinary matter. Post 5 alludes to the fact that she wasn't always able to turn up part time, it could be as simple as that, did she let them down at a key time like Christmas. Did she make it harder for another student to be employed, proabably, especially with the current rate of minimum wage.

Just my own perspective, as a full time student its hard to balance that with part time work. I would advise your daughter that if asked why she left previous employment state the following. "i was/am a full time student, unfortunately i was let go as these commitments were not compatible with my previous employers expectations for attendance".

Many employers would be satisfied with this, hope things work out for getting a new part time role for her.

The vast majority of responses are from people offering advice. Maybe not always what you like reading, but genuine advice nonetheless - not having a go.

People keep talking about the length of service but the letter does refer to either not carrying out the role as required, or misconduct. If it was just a case of "we don't have the work anymore", couldn't they just say that? It's not unfair or nasty.

I'm aware of numerous occasions where exactly that has happened.

In the letter the OP posted it literally mentions the employees 'length of service' multiple times so you don't even have to read between the lines too much to see the motive.

Are you reading too much into this? A lot of hospitality and retail slim down their staff in Q1 of the year as its the least busy time. She was someone who could be let go easily as she was there less that 12 months. There doesnt seem to be any suggestion that she did anything wrong - its a no fault dismissal for financial reasons.

Dont see why she wouldnt put the job on a CV. If asked why she left, just tell the truth - they were laying off for financial reasons etc.

Yes, the employer may be sh1tty in how he went about it etc etc, but its not your daughters fault and wont count against her in any way.

A 19 year old isn't a child. I told you what I thought tell her to grow up and don't be upset over a part time job and I hire people that age regularly and never check references. We all go through tough times and we deal with it. At 19 I moved to the other side of the planet without my parents help and no references. Tell her to have a cup of cement and harden up as the Aussies say.

that may be the case but no one really cares- you come across as overly emotional by keeping on saying this. See it as a positive that your daughter survived a year there and use that experience gained for the next opportunity

If you lived in my town you would know that he is in fact a horrible man. The reviews online are all negative bar the ones left by family members. She took the job to earn a few bob and stuck with it despite his abuse but she was looking for employment elsewhere.

in a roundabout way I think this is a great long term experience for your daughter- it’ll toughen her up and open her eyes to the world- in modern parlance “an opportunity to grow” - she was there for a year, stuck it out under a horrible boss and I’m sure learned many new skills- particularly resilience and perseverance - all that will stand to her. She didn’t quit or give up.
I would request the feedback as stated but don’t expect much honesty or insight. I’d immediately get to updating her cv and applying for the next role. Your man’s reference is irrelevant- a legal minefield these days

I'd need to hear the other side. It's strange how everyone is just taking it as gospel that the guy is a dick and the girl did absolutely nothing wrong/performed her duties exactly as obliged... when that's not the case. And that's no attack on her - she's just a kid (19 - adult schmadult) with loads to learn. I got fired from a retailer at 20. A customer complained me. Oh I thought the customer and manager were monsters, but it happened for a reason.

But anyway, I never needed a reference from them. It was just a college job - they really don't count. She can look for another part-time job and say she quit her last job because she was too busy with her study workload.

I was just about the post the same thing. This is a complete wind up thread. If it is real OP she's 19 years old tell her to grow up. She lost her job get over it. Regards to a reference in my job I hire 19/ 20 year olds regularly and I've never contacted a previous employer her CV will be fine.

If he a nasty man and you said earlier you were aware of this, I assume your child was aware also and an outcome list this not uncommon. Have others been let go in a similar way during your child's year there?
