No, it isn't. The root cause is his own actions. Actions guided by the belief that his opinion is the only one that matters.
That's utterly reductive logic, reaching for a conclusion. This was an internal school issue til Burke decided to behave in a manner requiring legal action - which he then refused to abide by.
He is in prison for one reason and one reason only - his failure to purge his contempt. No democratic society can function properly if citizens get to pick and choose which laws they abide by and which court rulings they are willing to accept. He has lost his case and now he and his family have simply decided that the laws and the rules do not apply to them. And if we accept this behaviour, then you can fully expect we'll have a whole lot of others doing the same and in all likelihood having committed more serious crimes. That is why, no matter how much it costs nor how much they try to disrupt court proceedings, behind bars he must remain.
The root cause is Enoch Burke is a bigot, a homophobe and a transphobe, who thinks his religious beliefs give him the right to deny a student's rights (under the Equal Status Acts) because God and his parents say so.
It has now been spelled out numerous times that the 'root cause' was left behind and became irrelevant when Burke behaved in an unprofessional manner in the school and continued this by being loud and obnoxious and disobedient to the courts - which is what led directly to him being imprisoned. The unprofessional behaviour was unnecessary and irrelevant to his opinions.
If you can't be bothered reading the rest of the thread then don't just seagull in with your uninformed opinions.
Enoch should have heeded the multiple warnings the judge gave him.

I can't think of any other situation where this has happened in Ireland in recent times and one that is this high profile.

I don't have too much sympathy for the brainwashed line of argument.
Sure, they are certainly the result of their environments but it has been shown that they are a family of academic high achievers. Several of them have successfully graduated from college. I know they caused a lot of hassle at NUIG but they still knew how to play by the rules sufficiently to get a degree. Iirc, some of them have master's degrees and at least one had a PhD or was studying for it.
Iirc, the one time they had any success.in court (one of them won a case against NUIG over their final exams), Ammi wasn't representing them and there was none of the theatrics that we've seen in other incidents.
So I don't believe that they are brainwashed to the extent that they have no capacity to think for themselves. I know they were home-schooled but there's no way the mother did all their degrees/master's, etc. for them. Ammi and Enoch were able to get jobs and, seemingly, Enoch was doing well until June 2022. I know Ammi's was a different story altogether.
They are evidently intelligent people which leads me to believe that they know exactly what they are doing. The parents certainly have a lot to answer for but several of them are adults now who have been out in the big bad world to a certain extent, yet they seem incapable of accepting any viewpoint they don't agree with. I don't think it can be explained away as brainwashing. Its far more complex than that.
I think that in the first couple of days he entered the grounds of the school but for the final 99% of the time he stayed outside.
If he enters the grounds without permission during school hours that's a different story, lock him up.
If he stays outside on public property looking sad then let him out. We are letting criminals out of prison early who have assaulted people and sold drugs. If we have limited spaces and have to make that decision Burke shouldn't be there while someone who sold heroin gets out because they kept their heads down and didn't get into trouble while in prison.

I won't even attempt to understand what the psychological effects are of growing up in that environment but the stories of the people who grew up in Scientology and left and shared their insights can perhaps give some insight. The damage is done before they went to the university in Galway to study their degrees and go back home in the evenings.
Yes, that's how it works. I'd have personal views on what should happen for him hanging outside of a place children go to school with no point in being there but that is not a legal matter or opinion. He should stay there until he purges contempt or the case is resolved and he can serve out his time if it is part of the resolution (it might not). If he goes back to the school gate after this, then unless the rulings change, I imagine he will go back again.
If someone who sold Heroin served their time and behaved, then yes they should, that is the system society has set out. Hopefully they will not return to it but if they do, they will probably be back in.

Burke, who travelled from his native Castlebar in Mayo, turned up before 9am and stood in a hallway in the building before leaving at around 4pm.
He did the same back in January. His persistance in entering the building is why WHS went back to Court.
I'm speaking to people being released early due to overcrowding, which is a regular occurrence in Mountjoy, not someone who has done their time/paid their debt to society.
I wouldn't agree with that level of punishment for a lad standing outside a gate who has not shown any intent to cause harm to the kids. I fear for the man who bumps into your child in the supermarket. You might find yourself sharing bunk beds with Enoch and could possibly convince him to stop this foolishness.

Cheaper, easier, and saner to keep him in until he purges his contempt. The Christmas release last year was a very very bad idea

Burke was given a chance and released for Christmas last year and he threw it back in the Court's face. As soon as the school reopened, he was back there, causing disruption.
After the multiple shows of contempt and disrespect Burke has shown both the Court and various High Court Justices in various appearances over the last year, why should they now show him any leniency?

If he stayed outside in a public area and didn't threaten anyone then I don't think he deserves to be put in prison.
It all depends to what extent he caused disruption. Prison should be for more serious crimes that some lad standing on a public footpath.
