Neighbour open a Tv that courier sent to him

Hi I ordered a new LG OLED TV and it came by courier yesterday. But there was a problem the courier despite having my Eircode address sent it to the wrong house. To my neighbours house who proceeded to open the package even though my name is on it and scratched the shít out of the panel while doing so. Can I send it back. Also the box has since been destroyed.

I would have thought so as the courier failed to do the job they were paid to do which was to deliver the TV to you.

Then someone else opened it up making it a second had TV by the time you got it and you paid for a brand new TV.

He is a foreigner who keeps to them selves so I didn't speak to them and don't actually know them enough to ask them why they opened it.

Did they destroy the box or did you destroy it? Sometimes they ask it is returned in its original packaging etc. Any pictures of the scratches, did they open the packaging with a scissors or blade and scratch it that way, or was it possible it was damaged before / during delivery?

Has the courier not have to get the OK to leave it with a neighbour or somewhere other than the address that is on the docket .I do some home delivery stuff with my job but would never leave something elsewhere without the ok to do so .

It looks like a blade was taking to the screen to remove the protective material. That is the main scratch, there are other smaller ones.

The guards would laugh at them, and rightly so. Also, it would do nothing to help the OP get what they ordered and paid for.

PO, just get on to whoever you ordered the TV from, and tell them you never got what you ordered. If they don't accommodate you by supplying a new TV, do a charge back on your card, or if that isn't an option, tell then you will be going to the small claims court.

I would imagine your 1st port of call would be the courier company as it's their job to get the package to you in the right condition what happened in between with the neighbour damaging it isn't your problem they were in the wrong surely.

Would have thought it was the couriers issue (insurance) to solve since they didn't deliver to the correct house & has been opened & damaged.

The courier is not your problem. They are employed by the company to deliver the TV to you (not a random neighbour). As others have said, get on to the company and insist they fulfil their contract with you. It's up to them to get compo from the courier.

Yes indeed. He knew it wasn't for him but opened it anyway and damaged it. The OP was lucky he found out where it was delivered to as his neighbour was never going to give it to him.

Your contract is with the supplier, not the courier. I'd contact them and make it their problem. You received the item damaged hence it's up to the supplier to rectify it. They can bring the courier or your neighbour to court etc if they want.

Can you keep us updated on progress/outcome as it's such a bizarre and interesting case in terms of the damage inflicted by the neighbour. The other thread has it just marked as Resolved which I'm not surprised with given RicherSounds are involved who are nothing short of fantastic. Granted the courier is to blame for delivering an expensive item to an incorrect address but what the hell is wrong with your neighbour to firstly open it and furthermore damage it. Surely they're liable to cover some/all of the damage as it would otherwise have been a simple fix and just collect the unopened box from them. Granted you may not be kept abreast of proceedings since it sounds like RicherSounds have supplied a replacement panel and your dealings with them are complete.

Not saying it's the case here but I have to say I rarely look at the address label on a package delivered to me. I would have probably opened it wondering who had sent what to me.
