Had he never had a conversation with his conspirators to stiff payment of Stormy Daniels after the election, Bragg would almost surely have no case.
But Trump can't help but put his foot in his mouth constantly, whether its slagging off marginally adequate GOP candidates or not following through on his hush money payments. Bragg has evidence, according to SOF, that payments weren't simply related to protecting his family from finding out. DeSantis would be a terrible nominee. He has gone all in on core culture war topics, which most voters either disagree with him or don't care about. He also shrivels any time he is put under any kind of scrutiny - why nearly every press appearance, even doing his job as governor, is done in front of a loyal cheering audience.
Overall, he is smarter than Trump but doesn't have a smidgen of Trump's charisma or media savviness. Trump would mop the floor with him with or without his legal issues

The biggest reason he's getting in trouble is that he's a cheap con-man.
Instead of paying her off out of his own pocket and "keeping Schtum" as it were, he tried to get his company to pay for it and hide it as a variety of fake business expenses.

Ive been wondering about the method of payment and if Cohen was buying himself an insurance policy to trade with in the event of getting caught which has has been. Last weeks Statement of Facts said that initially Trump wanted to pay the $130k in cash but Cohen said no I'll set up a shell company and they would route the money through that which then leaves the paper trail.
Its bizarre that he would knowingly run a criminal enterprise and then do it in such a way to leave a paper trail. Is Cohen that stupid or was he just making sure that if they ever got caught that there was a direct paper trail straight to Trump (who personally signed the cheques to Cohen for his 'retainer').
Because if this was all done in cash you just know Trump would have denied any knowledge of it. Trump would have thrown Cohen under the bus and Cohen would have spent way longer in prison than the 18 months he did if he had nothing to trade with. Maybe Cohen thought of that and said fcuk it if Im going down for this Im making sure he is too. Its either that or Cohen isnt the brightest which Im leaning towards. Like it wouldnt have been difficult to lay their hands on $130k cash but it was Cohens idea to do the shell company route which ultimately got them both caught.
All those things likely played a part , but even if they had "paid in cash", you just know that the cash would have come from the Company and not from Trumps personal accounts , because like everything else he considers it all to be "his" and has no understanding of the concept of separation of accounts and funds etc.
He has always used his businesses (and charities) as personal ATMs so I think he would have fallen foul of business accounting laws at the very least.
However , given Cohens habit of recording everything I suspect that at the very least he had enough street smarts to always have some kind of proof of all the things that Trump was getting him to do if only to make sure that he actually got paid for them .

no AFAIK they took care of tax, Cohen was paid way more than $130k, iirc it was 12 payments of $35k each. Some of that might have been the other payments to the Playboy model Karen Douglas but in the statement of facts the overpayment to Cohen is discussed as allowing him to net $130k for the Stormy Daniels pay off after he had paid his income taxes on a larger amount.
Maybe Cohen was ensuring a paper trail to snare Trump if any of this came to light. Because youd think Trump could have gotten $150k cash pretty quickly when running a hotel in NY. He could have sent a Trump Tower gofer down to Macys, buy Cohen a watch worth $150k as a bonus then Cohen converts his soon to be lost watch to $130k cash and pays Stormy. When they first discussed the scheme Trump wanted to pay her cash, it was Cohen who led Trump into the plan of setting up a shell company which ultimately got them caught. Without that paper trail Cohen was probably looking at almost 10 years in prison rather than the less than two he served. Trump would have thrown him right under the bus, maybe after years as working as Trumps fixer and shafting people on Trumps behalf he knew all too well that he was likely next.
