Do you think a court, one which has ordered and jailed Enoch for refusing to stay away from a school is going to be given their job back by court order? It won’t happen.
From the judges comments it seems the discipline procedure is already tainted and add to that the failure of the chairman of the BOM to turn up today (what are the chances of getting sick the night before the biggest BOM meeting of Ur career) I believe the school haven't a snowballs chance of getting away with any form of censure if it goes the legal route.
The school certainly don't want him back, that's for sure. I find it hard to see a Judge ordering the school to give him his job back should Burke win in court. But I've seen the courts do some very strange things so nothing is impossible. It is very unlikely though as Burke's position in the school is pretty much untenable.
If he is sacked, you can be sure that the only remedy Burke wants is reinstatement. I honestly don't think he gives two fiddlers about money. It's all about being the righteous hero for him.
It’s generally limited to 2 years pay except in cases of protected disclosures when it extends to 5 years pay. The WRC can also take into account any contributory effect by the employee even if the dismissal itself has been unfair. It’s not a PV of potential future earnings.
The judges comments are now irrelevant - in that they only apply to the injunction to prevent the hearing which Burke did' not want bad enough, so was not granted.
The disciplinary proceedings have not concluded yet, but assuming he gets fired then the legal route would be the WRC and then Labour Court which have their own rules, from employment law.

Does anybody know if there is any legal remedy to a disciplinary action short of being fired - say the suspended without pay route.
I'm not sure there is any legal recourse - or if it would only be the WRC.

In response to remarks along the lines of 'why did the school employ him in the first place' I repeat anti-discrimination laws say you can't discriminate on religious grounds and I repeat who's idea what that. So I think it's a bit hypocritical to say they shouldn't be employed in the first place.
Well you might argue look at their antics but all of their antics are done on religious beliefs grounds.
Another point is I'm a bit confused about what we've been told about this child T. Child T changed there name and desires to be referenced by they/them pronouns.
Strictly speaking transgender people do not desire to be refereed to by they/them pronouns, rather either she/he by their preferred gender.. So this child T seems to be identifying as non-binary, which is an umbrella term for people who claim they are gender fluid, either both male and female at the same time or flip between the two or neither.
So why did they change their name? Because there is no such thing as non-binary names. They could have continued to use the name they always had, in which case maybe this controversy wouldn't have happened at all. Like Sam Smith came out as non-binary but he didn't change his name .
And who is influencing a youth to use they/them pronouns. The internet maybe.
If the school want to sack him and need money to make a payout, they should start a crowdfund.
I'd happily contribute if it meant it would keep this asshole out of a classroom and away from other vulnerable LGBTQ+ kids forever.

Of course names can be non-binary / gender-fluid. Which is what non-binary is. The example you used, "Sam" , could be for Samuel or Samantha.

Your first point is just silly. There is no such thing as non-binary names because no one ever heard of non-binary until the last five years. Your point about Sam being short for Samuel or Samantha proves my point not yours.
The issue isn't what anyone choose to be called , the issue is changing one's name as a teenager and how that plays out in a school. Anyone can change their name if they want but that would defeat the purpose of having a name if we just felt like changing in on whim.
No it doesn't prove your "point" at all. You don't seem to understand that "non-binary" means it can be used for any gender.
Yes, anyone can change their name when they want, including a minor with parental permission. They can do it by common usage or deed poll. The school here had no issue with a student changing their name.
Do you have the same problem accepting it when someone asks you to refer to them by a shortened version of their name or nickname? Or is it just when trans people ask to be called by another name?

Also, it would have been very easy to decline to hire for reasons other than religion. Empoyers don't have to give reasons.
