He would receive compensation for sure but wouldnt have to be reinstated in my experience. Reinstatement wouldnt be anywhere near certain.
I'm not saying this will happen but it's a possibility...........If the school fires Burke, he may appeal. If he fails in that appeal, I'd bet my little 3 inch todger that he'll be off to the courts. And if the courts find in his favour that the disciplinary proceedings was flawed......which is possible..........then the sacking may have to be reversed.

There's a decent chance that the courts could actually find that Burke's disciplinary hearing etc. were flawed.

Fairly sure the Principal is a Board member. Knew of a split board, but the chair, a gobshite, then had an extra casting vote.
They are non voting members, which is the real crux of the issue. In an expulsion meeting the principal has to leave, and the DP if they are present to allow the board to rule. I've actually never come across what happens with a staff member, this is a pretty insane situation, but I'd imagine this should have been discussed with the voting member of the BOM only........this is to protect staff/students if the principal is just off one one........again, in fairness, shockingly rare but a good safety valve.
I am surprised they discussed it, it's a highly codified system. Maybe because they are private and not in a larger patron body they have been lax on the rules.

That’s my understanding as well. Principals are the Secretary of the BOM. Attend all Board meetings in that capacity but are not Board members. Can’t imagine the legal issues involved if they were

The biggest mistake they school made was going near him in the first place.
They could get away with firing him WRC be damned. We've seen how the Burkes get on when theres a big family day out. Any case would probably be long thrown out before they'd ever actually win it.

That's a silly argument and is typical of people who shoot their mouths off against the Burkes. Likewise the facile arguments about his mammy & daddy holding his hand etc. Since this came to notice last year, I was chatting with a family in our area who I know were involved in home schooling a few years back. Sure they knew of the Burkes and apparently the same Burkes caused problems in an organisation for such families. But and this is a big but, they said the Burkes were driven by ideology and religious conviction.
The idea that this is all about money is off the wall, the Burkes have fairly fundamentalist views and live by them to the letter. I would suggest that this is all about the principle of the matter in their view.
Which is why the school should have trod very carefully when the issue arose and allowed the situation to defuse of it's own accord.
To what end would they be in trouble? What would the possible outcome for the school be? Obnochious Burke wont be reinstated once fired no matter how flawed any process is. Yes he might get a pay off but thats nearly worth it now for the BOM and dept.
They are all unemployable after this. The lawyers in the family will probably go on the free legal aid circuit.
The school and dept. education are better off getting rid of him and taking the hit in the WRC.

It doesn't actually say procedures can be skipped. Yes, the charge can jump straight to gross misconduct but the procedure for fairly investigating it can't be skipped.
I'm not the expert on the law though. Here's what the Judge said.
In his ruling this evening, the judge said Mr Burke had met the threshold to allow an injunction to be granted on two grounds put forward by him – that a report prepared by the then principal of the school contained findings and conclusions made without giving him any opportunity to respond, and that this report was read and discussed at a board meeting, attended by the principal, to which Mr Burke was not invited.
The judge said he was fully satisfied that Mr Burke had established a strong case that he was likely to succeed in showing that the principal's report was discussed at the meeting to which he was not invited.
He said Mr Burke was also likely to succeed in showing that the attendance of the principal at the meeting was wrongful, given the particular facts of the case.
In this case, the judge said the principal was not only the person who prepared the report to start the disciplinary proceedings, but was also the person against some of the behaviour alleged to constitute serious misconduct was based. The judge found Mr Burke had a strong case to argue that the report itself was flawed.
Yeah, Burke would have gotten his injunction if he just shut his mouth at the hearing a couple of days ago and agreed to stay away from the school but he had to act the cnut and tell the judge that he wasn't going to abide by the injunction. The only positive thing I can say about Burke is that he's honest. If he had told a lie and said he'd abide by the injunction, it would have been granted.
The BOM may be adamant that they followed the Department's guidance to the absolute letter but they may still be in trouble because of the above comments by the judge.
I was under the assumption that principals were employees of the BOM and acted as secretaries but we're not board members. Ireland is indeed corrupt if principals are their own employers, sure that would make it impossible to fire or discipline one!!
