I'm unsure if there is a minimum age for travelling on/driving a horse and trap on a road/built up area but there certainly should be and it should be strictly enforced. It's the responsibility of horse owners to educate themselves as to the needs of their animals and act responsibly. If they are unwilling/unable to do this then I think removal of horses is the way to go.
