Garage Won't Return My Vehicle..;(

I left my work vehicle to a garage to have a second hand engine and gearbox fitted.
When the vehicle was repaired the garage sent me a short video of it been driven.When I Told the garage I would be paying by visa and that I wanted to have the work checked by an independent garage as it was costing 2,000 The owner threatened to remove the fitted engine and gearbox..That was on October 7th...I still have not got my vehicle back.

would anyone know how I should proceed from here..

Credit/Debit card is not legal tender so unless it was agreed you could pay using cards the only form of payment which the garage can insist on or must accept from you is legal tender Euro notes. It sounds to me you are throwing new conditions to the contract.

Did I read the posts correctly??you spent 2000 euro for 2nd hand engine and gearbox (most people will not give a guarantee for that)for a van that you were willing to sell for 1500,Maybe you would have been better off spending 3500 on a good second hand van?/ Anyway you made the bargain and will have to pay .

A few things come to mind.
Why did you use this "garage's" services when you were not going to trust them to do the work properly in the first place? Because if you did trust them, you would not be looking for second opinions.
How long has the van been ready and waiting for you to pay for it?
What can another independent garage tell you that a skilled mechanic with some tools and a portable analyser that you pay for and bring to look at the van can't tell you?
In the same way as your having doubts about their workmanship, why should he trust you to take the van away and come back promptly with the cash?
I know of many a mechanic that has trusted people to pay later, not to see them again.

The implication is that there will be willful damage done to the engine as a payback by the garage...I dunno!

I severely doubt that....they would more likely sell on the good engine and box...in an effort to recoup some of the cost as they are now waiting six weeks for payment and after getting you the sale of van which is after falling through in the mean time

It's usually accepted when your buying second hand parts the risks being taken...usually if there is a rapid failure the garage or scrapyard covers the replacement out of good will....which I doubt the op will get much of after this!!

What is the other mechanic going to see beyond the blindingly obvious??

I know of no mechanic who has xray vision and can physically see inside an engine/ gearbox without ripping...if he has such little time for the mechanic why did he not go to the maindealer to start with...seems the most unusual taught process to go through...Il go cos you cheap...on second thoughts you must be carp...so il get someone else to check up on you.....does the op have any reasonable reasons to doubt the quality of first garages work???
And if so why get them to do in the firstplace???
There apapears to be the issue with the reg number for the donor car...which I've never heard anyone wanting to check out the service history of a scrapped car...let alone expecting anyone to stand over the use of second hand parts

Why should he bring it anywhere, if you are not sure about things, then you should bring someone to the garage to check out the repairs, do it promptly, pay them and get on with things.

Personally I think there is more to this story that we are hearing.

perhaps i'm an idiot but I take people at their word when they tell me they are going to do x or y for 2000 euro.
so when suddenly x or y goes missing I get nervous and rightly so.This chap told me the engine I was getting was bullet proof, his words...so why wont he let me have it verified..i know its secondhand..but i'm not paying 2,000 for essentially is a pig in a bag..

Well which is it?

Was the original agreement expressly conditional on a 3rd party inspection? If not, the 'full price' is €2,000 and you drive it away. If you want to get it checked afterwards, that's your business.

No 3rd party was mentioned at the start I took his word that the engine was from this vehicle....but when he ignored my requests for proof of this so called engine I got suspicious...then I insisted on a 3rd party check.simple as that..as someone pointed out earlier, the trust is long gone here so it's more than likely going to end up in court.

Something strikes me as odd, you say you can't take 1500 for the van, but you have 2000 to pay the man with, why not take the 1500 and together with your 2grand you can go and buy something better, your story doesn't add up, pay the man his money and be done with it
