It is actually insane that you could batter a woman's head off the floor repeatedly, then bite her and not spend a minute in prison. On the back of the tinder rapist lad being released this week after 7 years was it (he should have been serving about 3 or 4 10 year sentences consecutively). There is something absolutely rotten at the core of this country. Shameful.

The Gardaí accepted he was acting in self defence, although what was reported on it wouldn't lend itself to that, even if the deceased had threatened and spat at him, which there was no independent witness to.
Also strange it took 5 years for this to make it to court, especially when the defendant had plead guilty.
Well, whatever the gardai accepted, the judge in her remarks was clear……Unprovoked, and against a defenseless person!….and then gives the man a 6.5 years sentence, with 1.5 years off; he'll do about 3.5 with remission. Disgusting sentence!

The detectives who interviewed all concerned apparently accepted his version of events, so it certainly can't be dismissed.
From a legal stand point, because the man died, self defence couldn't be invoked as a defence in court IMO, or at least have a chance of convincing a Jury, although you wouldn't know these days.
But I can see why the guards may have accepted he was acting in self defence if they believed his version of events.
To look at it another way, if I threatened to kill and rape you and then spat on you, and you instinctively kicked me but didn't seriously hurt or kill me, the chances of you being charged would be next to zero, if anything I would be the one libel for prosecution.
Not saying that is what happened, but there is some peculiar factors to this case.
He was never in trouble with the guards before or since.
The guards accepted he was acting in self defence.
The victims sister not wanting him jailed.
That said the Judge bought very little of it and went for near the middle of what the DPP suggested was the sentencing range, 18 months suspended for mitigation.

I don't think Ireland have first degree murder. Anyway, this particular crime that resulted in that man's death was tried for manslaughter, I think? I am open to correction here. I don't disagree with the manslaughter charge here, but to get only 6.5 years for it is bad
