I'm heartened to see that the bulk of the comments on Josiah's latest YouTube post (being removed from the Presbyterian Church up North) are disparaging and call them out on their arrogance and shameful behaviour. At the same time surprised that these comments have not yet been deleted.
You forget only Burke could appeal. It the same in any other process, whether its an employment case, court case criminal or civil, social welfare case. Results of an exam, a TAMM claim rejection. Only the party directly effected by the process can appeal.
Padraigh Nally sucessfully appealed his conviction for manslaughter after a judge erred by giving incorrect indtructions to a jury. An appeals process is exactly that. However its a process initiated by an aggrieved party of an earlier process. He dose not own the process. The basic tenant of such a process us that it is considered fair and that the make up of such a panel cannot be considered to have any bias towards the individual or the case he is involved in.
I do not think I am reading too much into this. Presently there are posters here extolling the virtues of Justice Cregan, these very same posters 6+ weeks ago wanted the President of The High Court to remove him from the case or to have a word with him after he allowed the basis for EB's tempory injunction. I pointed out at the time that there thinking was simlar to Donald Trump.
Cregan has played a blinder dealing with Burke. He dealt with the case fairly and followed legal due process.

It was a three person panel that was put in place twice. The first chairperson resigned after EB challenged there appointmentonnthe basis of biad, a new chair was appointed. Then two of this panel resigned and the fourth can/will not be part of any new DAP.
Employment cases fairly straightforward, the basic tenement is that they are fair. Would you consider Maria Steen or Declan Ganley appropriate for membership of a DAP dealin with EB, how about Micheal McDowell. Employers had a similar careless attitude for years allowing people involved earlier in the process, or managers who had interactions with the sanctioned employee being oart of an appeal process. Nowadays they have developed robust procedures for dealing with the process. To get the result you pick the right people.

I’m struggling to follow the logic of most of what you’re saying to be honest. It’s not that complicated a set of facts, including the fact that voluntary members of a panel are entitled to resign for personal reasons.

Random. But for that to be any way relevant, Nally would have had to launch his appeal and then immediately injunct his own appeal. But that didn't happen, so God knows why your brought that up.

EB's use of the word "bias" is telling. Your selective use of the term "bias" relating to the case of EB is equally telling.
