They should move Enoch up to the open prison near Blacklion. That would irk him.. plus its lower cost on the taxpayer
I read the judge then asked him - do you want to be moved back to Mountjoy? And Burke couldn't think of anything to say and then tried to repeat about moving him had no basis in law.
In other words it's all about time wasting and being a nuisance with this lot, the law has nothing to do with it.

I'd say judges are quite happy to let mammy and ammi stay under their own self imposed house arrest meaning the courts don't have to deal with their shenanigans.

He said the court had no role in the Dap process and any comment or remark made by the court on the process would represent an “unlawful interference”………………..The judge said he did not agree with Burke’s submission and said his sole concern in respect of the Dap was in the context of Burke’s ongoing imprisonment, and the court’s role in overseeing his attachment and committal.However, the judge said he noted Burke’s concerns, and in those circumstances, said he would not ask Mallon for an update.The matter will return to court later this week."

That's not a win. If he is claiming the court has no role in the DAP process, how come he keeps injuncting both the make up and the process. Going forward those words can be used against him.
As for being transferred in the prison system, that is at the discretion of the prison system.
Burke also noted that he has been granted an expedited hearing date in his attempt to bring a late appeal to Judge Owens’ judgment banning him from Wilson’s Hospital School. He said it was his position that his appeal should be determined before the Dap process continues.

Judge Cregan said he would ask the school's barrister for an update on the new Dap. Burke objected to this and Cregan agreed that Burke had a point and said he would not go ahead with the request. Burke would see this as a win, which is why I put it in inv. commas (irony). Nothing to do with the prison transfer crap.
It was on the grounds Burke objected to the courts not getting involved makes it a non win for Burke.
It only keeps Enoch in jail longer. It appears to be what be wants. The school has always been slow, so there will be no rush to setup a new Dap. Last I heard Enoch's salary from the Dept Education was paid into the school's account. Two Burkes are in hiding and Daddy Burke is manning the front door, holding off the Guards. A stalemate has been reached, it can be left going for months.

No it hasn't. There is a specific timeline the DAP have to adhere to.
The only thing making this process slow is Burke injuncting his own appeal.
At this stage its is obvious that Enoch is less concerned with release than he is with challenging the courts. Anything less than his full vindication and reinstatement in the school is irrelevant to him. He can be released 20 more times but he will end up in jail again each time. He doesn't seem to have much of a life outside teaching so it seems he is quite happy to challenge from within. The problem is he seems to think that every court procedure is set up for him to fail. This delusion is leading him to obstruct and delay proceedings at every turn. The court in turn is adopting an ultra cautious approach in granting him certain requests. But this is only delaying matters further. He is caught in an endless loop of his own making and is unlikely to ever divert from that approach to give himself an off ramp.
I imagine they are whipping through all 5 seasons of the wire before giving themselves up.
