People trying to give the impression that they be supporters of EB are posting on F/B that they want other people to show up at WHS this Friday afternoon to show their alleged support for him, or as the posters on the F/B posts put it "to hold the line".
I’d imagine harassing children is about the level those people are at, if they bother turning up at all. In the unlikely it happens could see some parents getting involved with moving them off.

The timing of this is interesting. The day before the court date. Is this designed to remove any wriggle room he has or does it mean the appeal process was flawed and we have to start all over again?
New panel, or if Burke somehow manages to coherently argue in court (hah!) that a third time around would be unfair to him, I suspect it'd just go up to the WRC instead.

I reckon you’re correct. Since every teacher in the country got the same LGBTQIA training, there will never be a panel to his liking. It will just go around in circles. If going straight to WRC is a route open, the adjudicator won’t have had that training so Burke doesn’t have grounds for objection.
Probably take years again for this to be resolved as usual.

I wonder is it just a case of the panel not having the time to deal with Enochs delay tactics? Meant to sit for one day and possibly a second followed by a meeting among themselves which probably would be held over Zoom. That was mid December and now is being dragged out into March at the earliest. You have teachers trying to prepare students for exams and maybe trying to bring families on Easter holidays being brought before the courts to drag it out even longer.

This is likely the panel stepping aside, letting a new panel rule on it, and presuming they come to the same conclusion demonstrate that any reasonable panel would come to that conclusion and the fault lies not with the panel, but with Burke himself. He will likely challenge the new panel for more spurious reasons, and show that that's all he's going to do regardless of who sits on the panel.
The article I linked to says “a number of resignations” which suggests two or three. Regarding why they resigned, all that we know about his application for the injunction was what was printed in the Indo. The claims were pretty serious, and the High Court later said he had raised serious and substantive issues in relation to the DAP hearing. I certainly cannot and did not say that any member or members of the DAP did anything illegal, however “unfair, unreasonable, unlawful and contrary to natural justice and fair procedures” covers a lot of ground and his claims suggest that the conduct of the appeal process was open to question. It’s difficult to see a reason for the resignations at this point other than the perception by the members that they were likely to loose today.

I'd be absolutely stunned if the 3 person panel didn't conduct the appeal meticulously in step with legislation and department guidance.

Raised doesn't mean proved. The HC have given him unlimited rope, which suits the Burkes but not people who give up their time to sit on these type of panels.
The letter also stated.

Also I wouldn't be surprised if any of the panel faced threats, given the sort that Burke has attracted.

At the end of the day the DAP are not legal people.
It seems Burke made them walk into his own trap. He wanted to question each of them on the panel. Would Burke be able to question a judge? No. Why was he allowed to question anyone on the panel?
This is what he asked one of them, when asked what they would do if a Principal asked them to use a certain name of a student: "If I were instructed by my Principal to call a child whatever, I have to implement that instruction, I don’t make the instruction”.
Burke has claimed that by saying this, they are prediduce of his appeal and it seems like the judges said he has a case to bring them to a court. Judges can't go by what was said unless it's a sworn statement so they would of asked them to come to court to see what the DAP would say and give them a chance to reply to Burke's claims.
They asked for time to reply ( 2 weeks) It seems like the DAP has now resigned, Giving more good PR to the Burkes.
So Burke has 'won' a small battle. His appeal has been blocked again by him. He wins by staying in Mount Joy for longer.
Yet he hasn't appealed his original court case, which was whether the first injunction was legal or not.
Something which has just struck me; what does EB do when he runs the appeals system into the ground [which might be actually what he is trying to do] with all his appeals to the civil courts alleging bias on the part of panel members, when there is no one left likely to [want or willing to] sit on a panel to hear his his unfair dismissal claim against WHS?
Would it then be down to the actual courts he and his family have been hectoring daily which would make a final call on his unfair dismissal claim against WHS, as he would have left the state with no alternative way of making a final decision about his claims?
Amusing once more to see Burke supporters on social media celebrating a 'victory' and a perceived increased chance of release. All he has achieved is the opposite with further delays. I'm sure he is delighted to be locked away from the mother for the foreseeable so maybe that's a victory of sorts.
