It would be interesting to know what will happen when it comes around to him being Garda vetted again via the Teaching Council. My understanding is that registered teachers have to be re-vetted by the Teaching Council every 3 years. To continue to be paid by the State, a teacher must remain registered with the Teaching Council. Continued registration is subject to passing re-vetting. Now, with 3 stays in Mountjoy under his belt so far given the fact that he will not comply with a court order to stay away from WHS, the question is would he pass re-vetting?
Certainly, if he doesn't pass re-vetting whenever it comes around, he's no longer entitled to be paid by the Department of Education.
The vetting is around child protection and I doubt his contempt of court issues would be raised in it.
All garda vetting does is return a list of known issues, convictions and so on for the person. It is then up to the requesting organisation (I assume in this case it'd be the teaching council) to decide, based on the information they receive back, if they deem the person allowable or not.

I'd imagine so. In fairness, a simple google search on the family would have told any employer everything they would have needed to know and he should never have been employed in the first place.
The contempt law being applied against him is the coercive version of that law, by which the court hoped to persuade him to comply with judges orders and stay away from the school. It won't work as he believes he's on a mission from a divine source.
He and his family have, as fundamentalist evangelical Christians, been bashing the C of I branch of the Christian religion the school is linked to, trying to make them do what the Burkes want.
AFAIK, he and his family have NOT asked the courts to rule that the school was acting unlawfully or had no power for it's decision to apply the change in school rules which he differed with WHS over. He has no legal power or right to decide the rules which the school applies within its terms and conditions to staff and pupils.
It's time for the legal eagles to open the up-to-date law books for another way of skinning the cat and get the high court judges off EB's contempt hook. If he cannot prove his religious rights contained in the constitution have been interfered with by the school, then close the door on his argument that it's about his being fired by the school.
His arrest for criminal trespass on a school probably would.
Either way it would want to be one drunk BOM to give this guy a job in the future.
If he wants to teach again, Asia or the Middle East will be his options.
Unless some private school somewhere in the world with similar levels of brain damage give him a gig.

So it appears he is fined for days that he is not in prison, now at 140 Euro a day.
"Despite his imprisonment he has been drawing a full salary from the school and will continue to do so until his expected dismissal is complete."
He was suspended -( put on administrative leave) on full pay, pending an investigation into his behaviour. The outcome led to his dismissal/ sacking/ termination of contract, whatever you like to call it. He appealed that decision, which he was entitled to do, and so his dismissal/sacking was put on hold, pending the decision of the appeal court, still on full pay.
The school better have all their t's crossed and i's dotted. I can imagine the burks poring over everything looking for a loophole, and the school having to appeal the appeal courts decision.

Seriously what is the fvcking hold up with the dismissal appeal? Surely that should be the priority now as once its sorted he can simply be removed from the grounds for trespassing as he has no right to be there.

I imagine the panel is sticking to the rules in given him 10 days notice to hold the appeal.

True but in terms of staff numbers he is absent and a substitute teacher needs to cover his lack of presence.
Therefore the school has to inform the Dept who the substitute teacher is covering for.

There is no appeal court.
He sought an injunction against the Appeals Panel because he objected to a member of that Appeals Panel, this person was put forward by the trade union.
As I understand it that injunction was granted "temporarily" and has since been thrown out.
The Appeals Panel are now free to either rubber stamp the dismissal or suggest an alternative.
The judges are to blame for this circus. Goes to jail for not complying with a court order, doesn't agree to follow said order, judge decides ah sure let him out anyway. Then the school is forced to start the whole joke process again. Can his appeal be dealt with when he's in jail? Is the reason he's out so that the process can move forward?

Technically yes, not whilst the temporary injunction was in place though.

He is out because it was not in society's interest to keep him locked up.
The reason he is still out is because the school haven't sought a fresh injunction.
One of the reasons for that I imagine is too allow the Appeals Panel come to a decision.
There is no way Mammy would let him teach Muslims or any other religion in Asia :)
As far as I can make out if your not a Burke you are going straight to hell.

Burke has to given a reason or reasons why the Board erred in firing him for gross misconduct.
Worth noting that Burke applied for the Appeal and then Applied for an injunction to stop the appeal.
He is a complete time waster who has sucked up way too much time and resources whilst causing untold stress.

Like I said previously they are operating in the grey and no one is willing to meet them in there.
In fact they are bending over backwards to accommodate it.
Whatever High Court Judge granted the "temporary" injunction which lasted over a year should really have a word themselves.

One would have to assume that he has a very competent legal team on his side where it comes on how to interpret Irish law to one's advantage better than that of at least three legal teams, the State (courts), Wilson Hospital School and the Board hearing his sacking case (parts 1 & 2). He and his family seem to have proven that the law is an ass and that there is no conspiratorial group set against them.
