What an honour.
Ireland's version of the Westboro Baptist church 😂
Sigh. And the headline has it wrong. Deliberately no doubt, as it makes better clickbait.
A teacher at the centre of a student gender row has been jailed a third time after he was fired for refusing to use a student’s preferred pronouns.
Better clickbait then the next more factually accurate statement, in the text:
A teacher in Ireland at the centre of a student gender row has been jailed a third time for refusing to stay away from his former place of employment.
That website is pure clickbait material. It's a Murdoch owned site.
there’s two types pushing that narrative disingenuous people with an agenda and morons who have bought it because they just believe stuff they read that fit with their beliefs.
Well, there's the answer to the narrative.
The problem for the Burkes and a lot of wing nuts of their ilk, is this isn't really about a tiny tiny portion of the population.
It's not about gender or 'saving the kids', it is and always has been about sexuality, particularly homosexuality.
Of course it is no longer on trend to openly bash the gays, so they have moved on with the façade somewhat with the 3 kids staying kinda on message. But Mammy Burke can't help herself, it's why when she is ranting and raving she has to shoe horn sodomites and other gross homophobic slurs into her screeching.
It's the reason they will never gain any sort of traction amongst the majority who are not hateful simpletons.
The kicker is, which is also a blessing, they have 10 grown children and no reported grandchildren. A rarity in the extreme in Ireland
Long may it continue.
Ignorance, sadly, will never die out - justclook at the recent Blighe et al escapades.
Thanks. I [think I] can finally get to understand the web of deceit the Burkes have run around the Board, the Appeals Panel and the Law Courts.
1. The Board is the one which decided he was lawfully sacked.
2. the APPEALS PANEL is the one hearing his appeal against the BOARD ruling that his sacking was OK.
3. He took a case to the High Court against the ASTI member on the Appeals Panel to the effect that member was biased due to his alleged Pro-Transgender stance in order to stymie that Appeal Panel hearing. He lost that case in the High Court.
4. He appealed that High Court loss to the APPEALS COURT, which is ongoing.
5. The issue of his salary is a side issue with no actual bearing on any of the appeals.
6. The fines the High Court issued against him may or may not be pursued in the future. As for the costs, who knows.
7. All we are waiting on is the ruling from the APPEALS COURT on whether the High Court ruling stands or not. If it stands, then the sacking process and the Appeal Panel hearing process are OK in law. Hopefully the Burkes wont continue the run and go to the Supreme Court.
How does that fit with the way things have played out so far?
Hopefully the Burkes wont continue the run and go to the Supreme Court.
Guarantee you they will, the only way to continue this particular grift.
SC will likely refuse the appeal, which kills it dead. There is no right to a SC hearing.
On an aside, while "googling" on the contempt law issue, I found it seems there was a bill going through the Daíl to update the law buy when the last change in Govt occurred and Josepha Madigan retired from politics, the bill lapsed as time ran out before it could be passed through procedure.
Madigan is still a TD and only announced her retirement at the next election recently.
If it failed to carry through after 2020 its likely FF weren't quite as interested in it as a FG+Ind Government were.
Can you go to Europe after that? Or if the Supreme Court say no, is that it?
Unfortunately yes (exhaustion of domestic remedies would include a refusal to hear an appeal), but they would almost certainly refuse it also on the basis that it's vexatious
The bill was allowed lapse, she over reached and try to shoe in all manner of things which in reality would have been unworkable.
If she just stuck broadly to the Law Commissions recommendations, it would have moved up the stages and in all likelihood have passed.
He won’t need to attend the COA anyway, it is simply just for the judges to make directions as far as i know and can find it. Basically setting a hearing date if they feel it’s necessary to do so.
As for your other questions yes to my knowledge you are absolutely free as a member of the public to attend the court sittings and will only be required to leave for in camera cases (which the judge will clear the courtroom themselves as necessary). You can probably pop in and check the list on the morning or just contact the court clerk.
yeah it would be pretty normal pace in my opinion. Thing is he’s just acting the bollix anyway.
The high court application he made to remove that individual from the appeal panel as well as the subsequent appeal of it’s rejection is simply an effort to delay the appeal going ahead.
The writing is on the walls here and he knows he’s running out of time and avenues. I’m assuming the next stage in his farce once the CoA sends him packing is either
Eventually he will run out of options and the appeal will go ahead and no doubt he will of course have his dismissal finalised. What I’m morbidly curious to see is when that happens will he continue to show up at the school!
I don’t think he can appeal to the European courts on this matter? What court would he be appealing to?
He could attempt to go to the ECHR. Attempt is the important word.
That his rights aren't being breached at all is the problem that should see any attempt kicked back immediately
How are they funding all these cases? Must be costing a fortune.
God loves a trier.
No legal costs to them with a trained solicitor (Ammi) and a trained barrister (Simeon) in the family.
If your talking about Enoch, He doesn't have a legal team.
Are they qualified enough to take high court cases?
Ammi is fully qualified, though I believe her area of practice was corporate law (open to correction on that). She used to work for Arthur Cox (that's another saga in itself).
Simeon has a law degree and recently qualified as a barrister but has yet to be "devilled" as far as I know.
They'd be informed enough to brief Enoch, who I believe is technically representing himself.
Self representation and not paying the costs found against them
You could represent yourself in the High Court. Not recommended though.
Members of his family would be well aware of how to navigate the courts.
As for qualified, Bothering Jesus and shouting "corrupt" at various Judges doesn't require any sort of formal training.
they’re self representing. Besides any fees for lodging the applications to the relevant courts they don’t have massive legal bills necessarily.
fair enough, I thought at some stage you needed a qualified barrister but obviously not.
perhaps for a criminal case but civil no you can represent yourself.
