Nope. He was arrested for Criminal Trespass. The DPP refused to prosecute.
So for the school to protect the safety of their staff and children they had no choice but to go down the costly stressful saga of multiple civil courts.

Last Friday the High Court issued a warrant that Burke be brought before the courts to answer allegations that he was acting in breach of a permanent injunction compelling him to stay away from the school.

Remember he had to be physically dragged from the courts last year after he refused to leave.
Every one of them are making conscious informed decisions to do each and every thing that they do.
They knew Enoch was going to get lifted at the school yesterday which is why they were there in force instead of the usual "dads taxi" approach.
They wanted to be there to film and to be able to shout abuse at the Gardai and to make their grotesque homophobic comments about Varadkar and so on.
This is all part of their twisted little "plan".
When they want to win and actually have a case to bring , they can magically behave properly and follow the rules of the courts but right from the start here they have known that there is no case , there is no legal "path to victory" for them so they have chosen the path of maximum disruption and exposure.

They;re not making up the law; the law gives them a fair amount of discretion.
Burke was released — I believe, with the assent of the school — for two, and possibly three reasons.
First, because keeping him in prison wasn't immediately necessary to prevent him violating the injunction during the summer holidays.
Secondly, because releasing him might help to expedite the progress of his disciplinary proceedings, which is something the school would dearly like.
Thirdly, possibly, out of a faint hope that, having been in prison and had a pretty horrible time there, he would be open to modifying his behaviour with a view to not going back. If he refuses to say that he won't violate the injunction but in practice doesn't violate it, that something the school and the courts could live with — they are concerned with what he does, not what he says — but there's no way of knowing if he will take this position except by giving him the opportunity to do so. Hence the release.
In the event, he didn't take the chance. But the only way of finding out whether he would was to release him.

Because until recently, Martina was the more vocal of the pair. She is the one who is in the videos, and shouts the loudest. She is the one who verbally abuses judges in court, and accosts politicians in public. It's only recently that Sean has been making his presence known other than as just a silent taxi driver.

RTE news has reported that the reason EB is still being paid as a teacher is that he went to the High Court with, AFAIK, a complaint about the hearing board. The High Court Court ruled that the board had not done wrong by EB. I do not know what the content of EB's complaint to the High Court was so cant comment on the rights or wrongs of the complaint or the courts ruling.
EB then appealed that High Court ruling to the Appeals Court and the status of his employment and pay rests there for the time being. Until the Appeals Court makes a ruling on it, EB will presumably continue to be in receipt of a teachers pay. I think it's inevitable, if its possible, for EB [with legal advice] to then try and state a case against that Appeals Court ruling [should he have lost his appeal there].
