The Director of Public Prosecutions makes the decision on whether a charge fits, and they decided against proceeding with a prosecution for trespass in Enoch Burke's case.
Enough said.
But thats not all she wrote. He was then ordered to stay away from the school. He refused to comply, so he was imprisoned. He was jailed but let out while the school is on summer holidays. The holidays have finished and he is back, not-complying with the judges order.

I was referring to the suggestion EB should be charged with criminal trespass or a public order offence. The thread has already been down that rabbit hole.
The time he was arrested for trespass, the DPP looked at the charge and decided not to proceed. It is their function to decide if any charge is likely to result in a successful proseceution in court, and they clearly felt it wouldn't.
Unfortunately, it's practically impossible to search threads these days, but you could go back and try and find the discussion about it, if you wanted to.
Or go in and sneak a few books on to the shelves.

Himself and his family are filled with the sort of "I am right and that's all there is too it" belief that a lot of religious fundamentalists possess. They see him now as some sort of martyr for a cause. They may be getting donations from people but I don't actually think that they are grifters so I don't think that's the main goal.
I have no idea what their plan is here. That school is never going to employ him again. Hard to see him or any of his or other unemployed family members getting work in this country again given their track record.
Honestly I think the best thing for the entire family would be for them to move to the deep south - somewhere like Alabama, where they'd find plenty of kindred spirits and would have no problems finding jobs and romantic partners. That's probably not possible though since quite a few of them have criminal records over all this.

Maybe because the DPP doesn't see him a a creep or a sexual deviant who is a threat to children as some here want to paint him as, and thus some sort of prosecution on the basis of him being a threat to children would not get a conviction.
One poster here suggested he be struck from the teaching register and placed on "another register" without a single shred of evidence that he should be on that "other register".
The same poster suggested that his father was some sort of social welfare fraudster.
I don't agree with Burke or his opinions, but equally it should not be a free for all on speculation about him or his family.

"Enough said" is a common figure of speech and I used it here in the sense that enough has been said on the topic of what constitutes trespass on thread already and there is no point in derailing the thread with it again.
God knows, last time was tedious enough. Some posters seemed to genuinely believe they were better quailifed than the DPP to interpret the law.
Like I said, you're free to go look for it, if you choose.
Strikes me as very unfair that it's continually up to the school to have to make the next legal move.
If somebody kept coming to my house I'd expect the guards and the courts to deal with that, not myself.

I wonder could WHS not put a couple of official 'bouncers' on the gate, or on every gate? They cost a lot less than lawyers, and it's not hard to identify the one person who the school need to deny access. Decent, trained security staff, who will do the minimum physical force necessary to stop him entering and no more.
