What is the story with them? Are people actually getting away with having them? its taking the piss in my opinion as are the people with no front number plate.
Is there fixed penalty points for illegal plates?
Once saw a nn L Mnnn car. I was perplexed initially, then thought Why would anyone do that to lovely leitrim?
Registration plate laws fall under VRT legislation so Garda don’t seem to bother enforcing it much. There are penalty points for having a missing registration plate tho.
I think revenue can fine you up to €5k for an illegal plate.
I think there’s more too it. Do they think it hides the fact it’s a ROI car when up north?
No
There is an issue with the legislation regarding number plates and some other issues regarding registration of vehicles.
I can't find a legal reference to it, but it came to light prior to covid.
But the long and short is, summons issued for number plate matters, won't hold water in court.
Edit:
So, the gist of it is.. Numberplates and few other offences were made Ticket-able offences (FCPN) , however, the minister has yet to assign a monetary value to the ticket.
In the normal course of events, a person is to be offered a FCPN if such is availible, and if that isnt paid, then , and only then can a summons be applied for.
The ticket cant be issued, cos .. the law says there is one.. but at the same time there isnt a fine, and you cant get a summons, until an issued ticket hasnt been paid.
Make sense.. it shouldn't.
Saw a tinted black and red 4D plate for the first time today while I was strolling through town, it was hideous. I don't get the appeal at all, and it made even less sense being on a bog standar 121 Pug 106 with a shoddy body kit. Or maybe that does make sense.
Saw one today, they were flying it as well of course.
If you run across a multi agency checkpoint involving revenue it's an automatic €5K fine. I imagine it won't be long before there's a bench warrant if you neglect to pay it in a timely manner.
I have been driving for 15 years and have never been through such a checkpoint.
I've only been breathalysed once at a checkpoint too.
We probably need more checkpoints...
Donegal has a large unionist community. As you may have seen on the news in recent days, there are still orange parades held on the 12th.
Have you ever heard of somebody being fined €5k for number plates? I’m not saying it hasn’t happened but I’ve never heard of it.
Edit: stupid jank quote "feature" that doesn't work right.
I've seen them a handful of times over the years dipping diesel tanks on trucks and whatnot.
Personally no, but it is in the legislation as per the citizens information link I posted earlier in the thread.
I think you're reaching a bit there, it's most likely done for purely aesthetic reasons.
You have to be offered a FCPN first
They always have a non-standard/not legal in UK/NI font too
If it were the Guards, yes but It's Revenue that issues the fine. You refuse to pay that fine then the Guards get involved.
To be honest I'm getting confused about the whole UK/ NI plate thing now
Trust me. No prosecutions are being brought for non confirming number plates, and that's information coming from the DPPs office.
They put an 60 odd year old man in prison for not being able to pay for a TV license, you can be guaranteed that they'll do the same for not paying the 5k fine. I'm not sure why this is so difficult for you but the DPP and AGS have nothing to do with the 5k fine or the license plates. That's all Revenue, however if you refuse to pay that fine then AGS and the DPP get involved and not because of a license plate but because you're evading fines. Make sense now?
But Revenue don't seem to be bothered as long as the car is properly registered in the State and all relevant taxes have been paid.
If we were serious about doing something to stop non standard plates being used we'd need a new plan.
Perhaps a more realistic fine, say €100 FCPN and hand the job over to AGS and traffic wardens.
Also just by the way anyone over 70 does not have to pay a TV licence.
I'm talking about in the context of a specific traffic stop scenario Revenue can do it, AGS can't do it because it's not within their remit. Revenue is the enforcement agency in this case as they're the ones issuing the fine but the only way that fine is going to be issued is if they are doing multi agency check points specifically for this purpose. Come to think of it I don't see why AGS can't report "offending" vehicles to Revenue themselves, particularly if they've stopped them for other traffic offenses. Ah that was a typo, it was a fella in his 60's not 80's and to expand on that it wasn't that he could pay it it's that when fined for not having it he couldn't pay it 3 or less payments and there was no adjustability to pay it in 4 payments over a slightly longer time iirc.
Revenue would be in for a field day if they ever cracked down on the ever increasing number of non legit plates around me. Leads me to suspect enforcement is non existent for what is a glaringly obvious issue
Makes you wonder if there's a sort of "rainy day fund" type thing going on. Ignore it for a couple years and then widespread crack down to rake in some revenue to balance the books.
Thanks for the comments.
I believe a rethink is needed if it is decided that non standard plates is a problem that needs sorting.
Clearly Revenue don't have the resources to effectively enforce the current legislation.
The fine for displaying a non standard plate on an otherwise legally compliant vehicle at €5k is out of touch with reality.
We are talking about people who think a German plate on their BMW looks cool or youngsters who want to their hatchback to look different.
Is it really a problem that requires a €5k sanction ?
Handing enforcement over to AGS and traffic wardens would increase the chance of detection and most likely over time reduce the number willing to take the risk.
There was an ex-Garda here who posted about the messy process for them to report such plates to Revenue, so messy that they generally didn't bother.
I'd be happy to report them to Revenue directly, if they'd actually act on them.
Ah so the it isn't a matter of including it in training updates or such, they just need to debloat the already existing process. Fat chance of that ever happening.
