There's probably quite a few issues wrapped up in this one story.
But just one in particular strikes me - the fact that medical evidence supported a claim that we only know to be false because of the happenstance that the claimant entered a Christmas Tree throwing competition.
Should there be any follow-up or implications for doctors who provide medical evidence that's just plain wrong?
Did she win?
In cases like this, the medical evidence is effectively 'the patient reports they feel pain here'. There's no scan, no diagnostic test of any scientific value.
I don't blame doctors for signing off on subjective evidence like this, I blame judges for giving it evidential value.
If compensation was only paid out on the basis of injuries that could be confirmed objectively, and not via self-reported symptoms, the stream of people looking for medical reports of this type would magically vanish.
Heard about thin on the radio this morning. I must say, I laughed. The perfect intersection between brass-neck and utter stupidity
What high principled solicitor encouraged her to pursue the claim?
So many chancers,
They should name the solicitors and doctors these chancers got to represent them too.
Good idea, give other chances a database of the ones to use 😅
😂😅😂😅😂😅
Should be sued in turn by the insurance company. Is this not fraud?
What I don't understand is who decided her claim is worth 760k?
People like her give genuine cases a bad name.
I know someone who has had to pursue a case because of life altering injuries sustained in a car accident. Other driver drove straight through a crossroads on their phone.
Solicitor has told them they 'might' get 60k, even though they are chronic pain everyday and off work now.
The solicitors probably rely on balance of probability of winning, not on the actual merit. Their job is to represent , not to judge. Doctors can only report what is claimed to them - and in cases of non objectively viable injuries, it is often difficult to ascertain who is a fraudulent claimer.
Yes
She should have to repay all her money she got from disability allowance she was on, might think twice on others conning the system.
Sounds like a Waterford Whispers story - you couldn't make this up 😂
Appropriately named anyway … <snip>
She would have signed an affidavit of verification of the circumstances of the accident and her alleged injuries.
They would have a hard time collecting but they might get a judgement against her and have it hanging over her in event of a windfall like lotto, inheritance etc
We should fund the Gardai via insurance for a proper fraud investigation squad.
Ordinarily to fight fraud you need boots on the ground and online as early as possible. It's rare you get this level of stupid.
Although years ago was involved in a fraud investigation of two clowns who staged an accident; problem being they were both directors in the same company. It's one of the first checks a half decent solicitor will make. Poor cnuts were played like fiddles for 12 months wondering when they would get paid, only to pay up 5 figures each.
Zero chance currently of getting Gardai involved in this or similar ime.
She did.
It is why her picture was on the front of the Indo.
Costs, its gotta come down to the costs, Judge should now award full costs against her, let her fork out for the bill for RSA 6 figures in the hole
+ should the Welfare go after her too ? this kinda crap has gotta stop
If she doesn't have any assets, what's the point?
Indeed it does.
It is costing ALL of us in higher insurance premiums and indeed higher costs to get anything done which leads to higher costs in general.
Full costs awarded against her wouldn't really be punishment enough if you dont have the money to pay them in the first instance but there has to be some detterant.
surely she should be jailed too
Banned from all future Christmas tree and midget throwing competitions too.
Hmmm. One day, she picks up and throws a Christmas tree further than anybody else in the competition.
Two days later, she tells a doctor she can't lift a bag of groceries.
She must have had a hell of a big shopping list that day, and a hell of a big bag to put it all in....
They need to come down hard on this. Make an example of her. Ireland's compo culture is widely known for the opportunity to abuse it without consequence.
This will keep happening otherwise. Is there any aspect of Irish society that's not rotten at this stage?
It would as her solicitors would be more aware that if its a lose and she's no money they'll be out of pocket so they will be less keen to take on the cases perhaps without a big chunk of money down
was talking to my GP about stuff like this once. he said he hates being asked to provide reports on insurance claims, because he's often unable to tell if someone is lying to him.
They probably work on the basis they win more of these cases than they lose so its worth the gamble.
I have seen a few of these stories floating about. It always strikes me that do these people not add 2 and 2 together and think if i am claiming to be injured just keep my head down until it pays out and not do something that may be recorded and prove I'm lying .
Learned from the best! https://en.wikipedia.org/wiki/Maria_Bailey
Was there any veracity at all in her claim, about a car accident.
Or was it a TOTAL scam in it's entirety?
To discourage others perhaps... Maybe people like this could be blacklisted from insurance cover? Some mechanism has to be found to discourage chancers. Costs being the very, very minimum.
It seems that there was indeed an incident but her "injuries" were grossly exaggerated.
The €760k piece is interesting. One has to assume that she was claiming for total, permanent disability as a result of the accident, otherwise the figures quoted make no sense.
