The optics of not jailing a former president for a failed insurrection are even worse.
Can you imagine if he was jailed. His crazy followers or someone sympathetic to him in the prison would properly help him break out anyway and that is assuming he would be in an actual prison and not in an open Prison if America even have them.

The beautiful part of all these court cases Trump is facing is that he has to be present every day in court for them. Between May and September next year he will be stuck in court day after day for months on end right in the middle of election season. This will drive him nuts, especially if the cases are televised and the whole nation gets to see him fuming in court, it will be box office.
And of course Trump will think he can leave court every day and go out to the press corps to slag off the prosecutors. If he does that (and Id expect him to) the judge will recind his bail and throw him in prison.
Summer 2024 is shaping up to be a very interesting time indeed, the Olympics in Paris will have nothing on whats about to go down in the US.

So again, what makes you think trump won't get a fair trail in DC? Do you cast the same criteria on the Florida case? Do you think trump's comments about what he saw of DC as he drove through put a finger on the scale of a fair trial?
