It depends if the Gardaí stated that no law was broken based on what they were being fed by RTÉ, or after carrying out an investigation themselves. As far as I know, there has been no criminal investigation.
Maybe there should be. I agree that the committee meetings are now going round in circles, with the key witnesses just blaming whoever is not in the room at the time.
It seems like misuse of public money, potential fraud, tax evasion if no VAT was paid, and several other charges that those more skilled in accountancy could comment upon. The country spent €250m on the Mahon tribunal, and after all that, no charges were filed and the star witness thinks he has a right to be President, god help us.
Surely there should be an investigation conducted by Revenue, and charges made if the evidence is there. The people asking the questions are not skilled enough in this area.

Deliberately falsifying the descriptions of invoices is definitely a breach of the Companies Acts.
The ODCE is the relevant authority, not the Gardai.
I believe it was a comment live on air, about the Committee being like the Nuremberg Trials.
Essentially if the label of the request /invoice is dodgy then the whole transaction has to be assumed to be suspect- any fool can see that and revenue are no fools.

In a way. They were called on emails from early 2020 which included BOK that confirmed the final agreement with Tubridy and which included the grubby little stroke. But RTE tried to claim that it wasn't actually a final agreement, and that that only happened with Dee Forbes after BOK had left.
Nobody believed a word of it.
Bakhurst confirms he's looking at moving RTE from Montrose.

Withholding tax is a red herring - it's just a means of collecting tax in advance, pay before you earn if you like. Even if Tubridy wasn't levied withholding tax, assuming he declared all income, then he would have paid/ pay eventually.
The evidence from the head of legal at RTE is damning of Noel Kelly. At least Ryan and Noel wasted their own money with their sham Father Ted type defense. Kevin Bakhurst has to cut Ryan and Noel loose now if he wants to be taken seriously. I can imagine there has been a few sacre bleus issued over at Renault HQ this week. Noel won't be working with Renault for a while! That might be the least of his concerns yet
