Tubs has a contract. If he holds up his end, then it's up to RTE to hold up their end. If RTE don't hold up their end, they are in breach of contract and Tubs would probably win in court if he chose to go down that route.

Aside from Revenue, Tubs is under no obligation to tell anyone his wage, including the RTE board. The RTE board should know, but that's another matter. The Board wouldn't be asking Tubs how much he is earning, they'd ask their internal people how much they were paying Tubs so that they could publish the earnings of their top ten earners.
What's Dee Forbes' angle in all this? Did she really thing RT was that essential to RTE? Seems strange.
As per @BattleCorp it seems unlikely that RTE could terminate his contract due to a scandal of their making.
If he was to do a podcast, it would need a sponsor as how else would it make him money especially as it will have very low listenership.
I'd be amazed if the money wasn't accounted for properly in Tub's accounts. It's not like it was a cash payment that he could hide under the table.
I'm curious how anyone thinks that if there's an anti-scandal clause, Tubs can be sacked because of it. That's laughable. It's RTE who caused the scandal, not Tubs.
But I will agree that if RTE don't let Tubs go back on the air, then they'll have to pay up.
He colluded to misinform the Board of Directors what his real wages were. The BOD were responsible for publishing the earning of the top ten earners in RTE.
Not only that he colluded as well to hide the fact he did not take a pay cut three years ago.
If I worked for a company and part of the condition my employment was my total earnings were supposed to be disclosed to the BOD and I and the CEO of the company did a deal to prevent the BOD from knowing my full earnings and if I also hid the fact that I did not take a pay cut when other did what do you think would happen.
Kenny wanted his contract renewed but it wasn't going to happen as he had reached retirement age.

He is contracted to provide a service to RTE and can no longer provide that service as his conduct had damaged his standing to discuss current affairs.
Depending on how the contract is worded of course. A properly run company would have protected itself but RTE being the corrupt (as per PAC) gombeens that they are probably not.
If they can't sack him and if they're not letting him back on air then they'll still have to pay him out until the end of his current contract.
Revenue are the ones who will decide if what he did was illegal. I'm not sure it is, if he declared all monies to them. As said above, there will be an anti-scandal clause, we'll have to wait and see if this covers it.
They could come to an amicable solution, pay him off some of whats due and tell him to go off and do what he wants. Time will tell.

Customers don’t invoice you for services though. They pay you.
If another business is invoicing you, they must be providing you with goods or services. Otherwise we ARE into fraud territory.
And if a public body chooses an external business to provide a service, they are supposed to go through procurement processes to ensure value for money.
From the figures quoted, it seems this agency charged close to a 50% fee on the payments. Maybe there are other agencies who would have made payments to Tubridy for a 20% or 30% fee?
Was Pat Kenny, not an RTE employee? someone I consider well past his sell-by date at this stage. I have the radio on all the time from 10 am unless I'm at work, it's Today with Clair Byrne and I do listen to it, switch between Louise Duffy and Andrea Gilligan on Newstalk, then its Sean Moncriffe, really enjoy Moncriffe, RTE radio 1 is very good in the evening, Arena, John Creddon, The county measure was a gen program, there are things that RTE radio do very well.
He's received over €8m from just RTE in declared fees alone over the last 20 years. While wealthy people undoubtedly have expensive lifestyles I'm sure he's put a good chunk of that away. He'll be alright.
I've long thought that when it comes to paying the "stars" fees, that RTE really weren't competing with other Irish stations, the BBC or anyone else but they were essentially competing with themselves. They paid these people so much over so long that they were more than comfortable, enough that they didn't need the work anymore. The insane money was the carrot to get them to continue coming in.

RTE failed to publish his wage properly. It was RTE who was responsible for that. That was on them, not Tubs. Legally Tubs was under no obligation to reveal his full wage nor to correct RTE's mistake.

Not necessarily. The board could sack him. ASA senior presenter he colluded to keep his real wages from being disclosed to the board and to the public a condition RTE had to adhere to.
If similar happened in a private company all those involved wound be sacked and they wound be left with trying to sue for unfair dismissal.

In the old days maybe but now you can self publish and publicise on amazon, twitter, youtube, podcast platforms.
If RTE don't put him back on the air, RTE will more than likely have to pay up whatever is left on his contract.
Remember the scene in the movie "Goodfellas" where Paulie cut off Henry Hill? If Tubridy is gone from RTE, it will be like he never existed. No book promotion. Maybe even no publisher would want to take anything he's written unless he's doing a tell-all. Podcast? The same promotion problem exists.
That's a major problem for him and others who may be affected by this. People don't seem to listen to the presenter but simply have their radio tuned to a specific station and are too lazy to change it. That's if the audience figures for these programmes are accurate. Pat Kenny leanred the hard way that it wasn't his audience when he didn't have his RTE contract renewed.
Any decent contract would have a get out clause where any 'scandal' associated with the presenter makes the contract null and void - However RTE are a bit thick so may have missed that
Podcast... book maybe... something voluntary for his fanbase - nothing broadcast to general national audience.

Unfortunately, in the not too distant future he will make a reappearance in some guise or other to feed his overinflated ego.......
