Wilton SC car park clamping

Just to let everyone know, they are clamping cars (in the corner closest to CUH) that are parked there for whatever reason.

Correct me if I'm wrong but as far as I know only the guards or city council is allowed to clamp cars.

Also, I am pretty sure that scribble doesn't count as somebody's signature. So it's a scam basically.

Why do you think the signature on that notice isn't a clear signature but rather a scribble? The person putting that notice on somebody's car doesn't want to be responsible for anything. If they are serious and confident they can do it then why not signing it?

If they don't want people to park there for more than 3 hours then they can put up some barriers and give people tickets with barcodes. When you leave in less then 3 hours you just scan it and off you go. If you're staying longer then pay.

But this kind of cat and mouse game is not very sophisticated. Somebody hiding behind a tree writing down regs. I mean are we in the year 2023?

1. it's private property, they can clamp.

2. I don't think you really understand what a signature is. A signature does not need to be legible, just be recognisable.

3. There's an employee number on the form. No one is hiding anything.

4. If you don't pay the release fee, presumably they won't remove the clamp and you would lose the use of your car while the courts deal with it. Could be years.

They cannot clamp, you are seizing somebody's property and then extort money from them. Pretty sure it's a no no. You can tow your car away with the clamp on it, it's your car and your property. You can do whatever you want with it and they can't stop you.
It's a scribble, not a signature. Signature is a person's name written in a DISTINCTIVE way as a form of identification in authorizing a cheque or document or concluding a letter. That is not a signature.
Employee number, you mean month and year? 05/2022. That's made up in case you haven't noticed.
You can remove your car though. With or without their consent.

They don't like people parking there for more than three hours, as noted on the signs. If you don't like theirterms and conditions, you can find storage space for your private property elsewhere.

But what does it matter who the employee was? If you overstayed, you get a ticket.

1. It would appear that they most certainly can clamp on private property, as evidenced here.

They could stop you bringing a tow truck onto their property.

2. A signature can, literally be a scribble. It does not need to be be a persons name written down and does not need to be legible in any way. You don't get to decide whether someone's mark is a signature or not.

3. It's a staff number.

4. You would need their concent to get a tow truck in to take away your car.

Why don't you try some of your ideas out and let us know how it plays out.

Cork City Council haven't clamped a car in over a decade and no longer use the practice. The Gards don't clamp either.

Private Clamping is regulated by the Clamping Act of 2015. The clamper has provided all information legally required of them on that notice affixed to the window, there is zero requirement for a signature or identification of the individual worker who attached the clamp so it really doesn't matter at all if you don't like it.

No matter how many times you repeat that they can't clamp you're wrong. It's that simple, they can and do.

You don't need to install a barrier system to have restrictions on your parking lot on private land. These requirements you are making up are not mandated nor governed by any specific law....

This has been happening for years. Definitely not a new thing. It's only ever that corner they seem to clamp. I used park over by Tesco, walk through and never had an issue. Staff park there, and in the overflow, all day. I don't see how it's an different from Apcoa clamping in Circle K garages, the train station and some Aldis.

Just because they do doesn't mean they can. You can drink 5 pints and drive a car, but that doesn't mean you should.

Obviously nobody bothered to take this to court. I certainly would like to see the outcome but logically taking somebody's property as hostage to charge money doesn't mean it's right. It's a hassle to fight this in court.

To me it's obviously a money generating scam.

There are signs all over the place telling people about the 3-hour free parking limit.

They've started enforcing rules for people wrongly parking in disabled bays and on the yellow cross hatch in Mahon Point now, first time I've seen that.
