Personally I wouldn't want to take any chances. There is something very very off with these lot in my opinion.
In the 3 minute vid where he gives a speech outside the school, in the indo article above. It sounds like he is saying that his dismissal is not immediate, I wonder is there any truth in that?

I noticed that as well. My guess would be that they have decided to pay him to the end of the month (or even next month) in lieu of notice, and he is interpreting that as meaning that he is still an employee.

In the Department’s circular (Appendix 1A) it states:
4. A teacher who has been notified that it has decided to take disciplinary action against him or her may, within 10 school days of receiving the notification of the decision, request in writing that the disciplinary proceedings be reviewed by the Panel.
5. If no such request is received from the teacher concerned within the period of ten school days the appropriate authority may proceed to implement the disciplinary action proposed.
This appears to me to show that the disciplinary action (in this case his termination) does not apply until after the 10 school days, since point 5 says the school may proceed with it at this point (if no review is requested).

Technically it probably isn't as he has 10 school days to apply for an appeal.
The school has to reply to this in writing, then the panel has 20 school days to set a hearing.
The panel is under no obligation to set a hearing though and can throw it out before, which considering this muppet can give oral evidence I imagine they won't be too keen for a face to face with the chanting cult.
Either way though, whether he is suspended or dismissed or in between the school have always been entitled to ask to have him arrested under public order offences.

I wonder if this applies to fee paying private schools though? I understand they’ll still be adhering to the DOE rules but surely they can’t force a school to employ a teacher since it’s not a public school where they are the only authority to speak of?

Disciplinary action is the decision to carry out a process of determination around alleged conduct or negligence.
Termination is the outcome and there is no waiting period on that.
His only recourse is to appeal it legally, but make no mistake, as of last week, Enoch Burke is no longer an employee of Wilsons Hospital School.

No, it doesn’t. Stage 5 is the appeal process after the hearing it says:

Appeal
5.1 It will be open to the teacher to appeal against the proposed action of the board of management. Such an appeal will be heard by an independent appeal panel appointed by the board of management.
5.2 The procedures for appealing to the independent appeal panel are as set out in Appendix 1 A.
Appendix 1A is the bit I quoted above.
No, the “disciplinary action” is the result of the hearing, not the process or the hearing itself. Read the Circular, it’s laid out very clearly.

I'm sure there will be some other loons who would like him teaching their kids privately. You know the types. Getting employed by the department is definitely off the table of course but I'm sure some religious nuts would be happy to acquire his services. We have some on here who would have no issue with him teaching their kids I'm sure.
100% according to who? has he had a psychological evaluation? Not everyone fired ends up in the workplace relations commission - in fact not many do in fact. He might do anyway as that’s his way but the point I was trying to make was all the drama, injunctions etc, then the firing. Normally abuse of your boss would be enough. Not a long drawn out issue
