There had better be a Garda presence there in the morning - They know that there is a high degree of likelihood that a crime will be attempted tomorrow morning , so they need to be there to prevent that crime.
As others have said , the longer this nonsense goes on the greater the chance that a 3rd party (Parent ,Student or even a member of staff) gets caught up in it and gets themselves into trouble because they react badly to this guys obnoxious behaviour.

Employers can make referrals to the Conciliation Service, but in the case of Burke, those procedures would not apply as they deal with collective issues only rather than matters of individual rights or complaints.
Gardai may well call to the Burke residence and have a word with him about it anyway.
It doesn't cover the number of cases withdrawn before they go to adjudication or the number of cases that die after a phone call to the WRC. Talk to someone in the system there if you don't believe me.

Bail would be dealt with in Court. It is standard practice for Gardai to release a person and send a file to the DPP .
I know that's when it was originally scheduled , but my understanding was that it all became moot once he was sacked as the purpose of the original injunction is no longer applicable.

Ok well, the law of this land is now being ridiculed.
The Gardaí need to keep him in custody until a Court hearing can be held. At that hearing he will be bailed, and no doubt head straight back to the school.
When one foot goes in through the gate, he needs to arrested for contempt. He will then refuse to purge that contempt and be remanded to prison.
And there he should stay, for the rest of his natural life if thats what it takes.
If common law and the preeminence of the Courts of this State are allowed to be mocked, we may as well give up on holding anyone to account, for anything, ever.

For the school , as he is no longer an employee they call the Gardai and have him arrested for causing a disturbance, which he was.
Him returning to the school, having been presumably already given a warning by the Gardai to not return under the Public Order act you would assume just adds icing and sprinkles to an already solid case for the DPP to act on.
A custodial sentence is absolutely in his future as he has repeatedly shown that he has no respect for the law and the judiciary so a fine and/or suspended sentence would be of no value.
If convicted of the public order offence he is going to prison without doubt.

Indo reports he claimed he was “wrongfully arrested” and that the Gardai spent 45 minutes in the principals office before arresting him “without observing the situation”.
