Yeah I don't know what to cut tbh - but worried if I'm trying to learn too much i'll remember nothing 😂.
I am also cutting President and AG, Oireachtas, International Law, War & Emergency, rights of life of the unborn and Nation, state & Sovereignty and the Courts (just doing the in public aspect from that chapter)
i’m also cutting these topics plus due course of law just because it’s so broad don’t think i’ll get it covered in time 🥲
Yeah I think in due course of law the most relevant aspects will be right of access to a Solicitor/ delay and obtaining evidence. So I think I will just try to remember a case from each of just to have something to throw into a problem Q if it comes up.
Yeah, apparently, he's stingy with marks even if the law is correct but its not applied how he wants. How did the other two failed exams go? Did you answer 5 questions on those papers or what?
Company was my first ever Fe1 exam yesterday. Haven’t sat an exam in almost 3 years. It probably wasn’t the best one to start with and my confidence is kind of knocked. Does it get a little easier then this?
Yes - I would say from experience that Company is one of the harder ones - not a lot you can cut out, topics are mixed in Qs and Courtney is a very particular marker. So don't worry, the majority of them are a lot easier, where you are not as required to learn as much and the exam grid is a bit more predictable.
Thank you! That makes me feel a lot better. First exam is always the hardest regardless!
Is the examiner in tort a lenient marker?
Does anyone please please have notes on EU Citizenship they could send me please?! I cannot understand it for the life of me 😣
I'm giving main focus to O&A, Consideration, Exemption Clauses, Terms, Discharge and Remedies! Then focusing less on mistake, misrep, undue influence, estoppel and consumer protection!
What are people focusing on for Equity?
Anton Pillar Order. Charitable trust/Cy-pres. Estoppel- unconscionability & farmer/farm-hand prob q. Mandatory Interloc. Mareva injunction. Purpose trusts. Quia Timet injunctions. Undue Influence. Specific Performance. The rule in Strong v. Bird
Not sure about discharge, it's come up 8 times in the last 5 papers. Could be due a miss this time out?
Are you preparing for an essay for undue influence or for a prob qu?
Essay, if a prob comes up i can usually work the essay around it.
How did everyone find the property exam?
I done finding/treasure trove. Construction of the will/extrinsic evidence. Adverse possession. Child right/S.117/Intestate succession and Easements. Done 5 strong answers so quite happy with it.
For property I had 4 good answers. I did the note question and for the first part and I answered it well. For the second part I interpreted the question wrong and may have got 0. If I got 11 in the others and 6 in the note question I’ll pass. Do you guys think the marker is generous?
Charitable purpose, cypres, non-charitable, Mareva, mandatory interlocutory, undue influence, 3 certainties, trustees, proprietary estoppel, specific performance and rectification, satisfaction note, strong v bird note
Just fyi trustees and 3 certainties are big predictions and quite easy to understand.
Trustee's duties?
Yes. Particularly the question on them making a profit.
Sorry for bringing this up - anyone from company do the retention of title question ? Do you remember exactly what part b was and what did you say ?
Have there been any predictions as to what way Mareva could come up?
Not exactly word for word but it was a question on fixed book debts, the charge over the book debts was registered, the charge over the bank account was not registered, so Revenue were trying to assert their priority over the debenture holder who i think was the bank.
I most certainly got it wrong because I was caught short with topics I had studied so I just chanced my arm, no point telling you what I said lol.
Charges over book debts. I mentioned the Finance Act 1997, section 174. Holder of a fixed charge over book debts will have to pay the company’s debts to the revenue commissioners subject to notice being served on him by the revenue commissioners, up to the amount he has received from the company in payment of the debt.
Essay on showing there is a real chance defendant will dissipate assets. I’m pretty sure that’s the only way it’s ever really asked - correct me if I’m wrong.
Does anyone have exam papers and reports for Eu March 21 -March 22
putting this observation out there because it might help people study for next weeks exams - I’ve sat property and criminal so far and noticed both have repeated questions from last sitting (when they used to be known for being quite predictable) idk if the examiners were told to shake it up a bit - but I’m taking this into consideration for my exam next week 😅
So did Company, I think you're onto something here!
I did 5 but left sec604/608 til last and was a piss poor answer. Fingers crossed did enough.
