Looking at your example 2, you could substitute “John” for “them” and while it is clunky it is not incorrect. If Mr Burke wants to be an educator he could look for the middle ground allowing both to respect their beliefs.
Klinefelter (XXY), Swyer (XY women) and de la Chapelle (XX men) would show you that there are people with differences in sexual development which means that there are not exclusively two sexes. That being said, DSD is not a feature of transsexualism in particular.
They are not considered separate sexes. People born with those atypical Karotypes are still either male or female. People with DSD’s may indeed identify as trans but many more do not. A DSD is a medical diagnosis and being trans is an identity so they are separate things.
It seems that the injunction is not being complied with and the school have filed a new motion.
Counsel said that despite being served with, and being made aware of the interim injunction Mr Burke attended at the school on Wednesday and Thursday.

Yet again the Burke's have highlighted for us how many employers still seemingly don't take the simple task of googling the name of any prospective employee; there was his sister at Arthur Cox, and now this case.
Surely a simple google would have highlighted their track records from their time in NUIG, and any employer with an ounce of sense would realise that hiring them would be more trouble than it's worth.
I feel bad for the child or at best young adult at the center of all of this.
The teacher has gone out of their way to cause as much trouble for the school as possible. Including willfully ignoring a court order. Hope the Judge jails them, they'll be popular in jail right?

You can't change human biological gender after birth. Thats the science I refer to. Its not on your side.
And the existence of some rare individuals with something other than xx, or xy isn't changing that.

Yup, this. You can change your name via common usage, or use and repute in Ireland. I changed my surname that way (it was double barrel originally), as did my sister. We all know of people who are known by their middle or nicknames, and they can legally use those names. Even after marriage, you can just start calling yourself by your partner's name. Even changing your name by deed poll, you just pop into a lawyer with a witness and sign a piece of paper to say this is your name now. There is no ceremony or waiting around. There's no waiting to see if your name is accepted. You sign the paper, witness signs an affidavit, and off you go. If needed, you can enrol it too but for the most part, that's all there is to it.
So "legally", in Ireland, you just tell people that's your name now and that's it "legally" changed.
This used to be referred to as " seeking martyrdom" Which is exactly what he is doing. Set on and determined to get arrested for... kudos.
Thanks for clearing all that up. Seems a bit crazy but suits this country in fairness. Nicknames I don't agree are "different" names, as when required officially for, say, a passport or driving licence they would have to use their "legal" name. Just think it's crazy you can wake up one day and decide today I'm not Tim, I'm Mary. Should be a more robust process imo, and that's just my opinion coming from 10ish years of policing. /offtopic
See this is what I can't get my head around. They all have mad first names so any prospective employer should straight away know the name, Google them and put C.V straight in the bin.
To be honest I'd have very poor opinion of employer who didn't cop this.
Once you call them for an interview your on slippey slope where they could sue you for not getting the job.
But you could literally always change your name to Mary, only difference is that gender gets recognised as well. In this case, he refused to even accept the name. And all this does involve the individual going through considerable thought etc in relation to it.
Gender isn't biological. Sex is biological and isn't binary.
The truth is, biological sex is way more complicated than XX and XY. That's what's taught in schools because it's less confusing. Not only are there the above, but you can also have things like a person with XX chromosomes and testicles and vice versa. The system is place to become one sex or the other is actually quite a delicate process. There is a silly amount of things that can and do go wrong in the process that doesn't result in the binary stereotypical XX and XY expression. In fact, looking at the odds, having majority of people come out as typical XX or XY is what's baffling. Between different genes, receptors, interactions, hormones; all having to work exactly as expected, in the exact right amount, at the exact right time, without any mutations... it's really amazing.
You can say that, well, all that shows physical outward signs. Sure, you can just look. Transgenderism is all in their head. Well, yes, and quite literally. There are actually emerging studies showing physical attributes and structural differences in the brain. Some of these studies show attributes more aligned with the sexual dimorphism of their "chosen" gender, some of them show entirely unique attributes. In fact, there's a part of the brain that was previously thought to be either male or female in size, that they're now believing is more of a spectrum with gay men showing to have a similar size to straight women.
So please, don't talk about science if you haven't actually looked into the science of it. It's very unscientific of you. And that's only talking about biological sex, wait until we delve into societal gender

Not selecting someone after an interview doesn’t open you to being sued by every unsuccessful candidate - just so long as you don’t say something stupid or actually discriminatory as a reason for not hiring them.

By nicknames, I mean calling John "Jack", or Sarah "Sadie", etc. Not so much Jonny "MadBoiz Jon". So long as you can prove they've been used for the last two years (for example, bills), you can use them on official documents.
Changing your name every week won't work, but that's not what's happening here. The only time I've heard of it being a problem is by people holding it against transgender people. Nobody has ever called me by my old surname. The only time I've used it was playing "red letter" in school because it had some uncommon letters in it. Most people don't even know that a friend of mine uses his middle name because he had the same name as his father. People change their name in some way all the time and nobody bats an eyelid.
Edit to add: based on the policing comment, changing your name to commit fraud in any way is still illegal.
Once you've been using a name for 2 years, be it a nickname or another chosen name, you can apply to have your passport and drivers license issued in that name. Your name is whatever you are known by, however you came by it.
