Plenty of people who travel a lot will have two passports from the same country as they often lose one for visa purposes etc. Its just something you have to apply for.

Or if you ever have reason to travel to both Israel and Iran you'll have two, as once you have a visa for one in your passport you'll not be able to get into the other.

I don't think they can take passports on the basis that there's no real evidence in it.
He can be ordered to surrender them at some point (which he probably won't - or at least will make a song and dance about) but I'd imagine they'd have to get to the proceeding-with-trial stage first.

Although even if he doesn't hand over the passports, he still cannot use them as in order to make use of them he'd have to hand them over at which point they get flagged and he gets detained.
Of course it's not like he can just sneak out through passport control anyway, and I'm sure the Secret Service detail could be told to not let him leave the country... Isn't there something about the former presidents needing permission from the current to leave the country as well?
