Do people think the sentence is fair? I followed the case. I think it is about right. Probably on the lower end of a sexual assault case but i do think a custodial sentence was required.
I agree none of this sits right at all and seems way over the top and even for the judge to say its an unusual case. So therefore he should appeal the prison sentence and her mental health be taking into account. I'd even go as far as checking if she had any issues prior to all of this which undoubtedly played a part in the sentence.

You never included "while she was asleep" why does everyone consistently leave out the most pertinent part of the whole case. He initiated while she was asleep.

I guess the bottom line is he shouldn't have initiated sexual activity while she was asleep. To be honest it was very unfair what he did. She had the right to sleep without being party to sexual activity she wasn't aware would happen before it started.

This isn't a I thought she implied consent or I read the singles wrong case.
It's the one thing that is crystal clear in the law, a person that is asleep cannot consent, therefore if you touch them in a sexual way that is sexual assault.
It's also there for good reason, now you could argue the law should be changed based on your own beliefs, but trying to water it down would certainly be a slippery slope.

It's called jury nullification. This is when the jury understands that the law has been broken but doesn't agree that the offence should be illegal.
Judges tend to not like when juries go down this route and in their closing remarks and direction to the jury they don't tend to outline this option to them. It doesn't mean it doesn't exist however.
