Terrible loss of life, but to me clearly self defense.
I'm very relieved for the accused.
'He came from an area that that would make the East Wall or any part of Dublin like a Sunday school kindergarten.'
Yet you can get killed in East Wall, or in other parts of Dublin, and people are killed.
So no matter how fierce people think the favelas of Brazil are by comparison, Dublin is still quite rough.
Boggles, this is delusional stuff. If Fachtna O'Sullivan from Monsktown who went to Clongowes with a Supreme Court judge for a father booked flights to a non extraditing jurisdiction the day after stabbing someone and they died - he is not getting bail.
That's a hard fact of life.
That you think he should have skipped town and be drinking cocktails on the Copacacabana really displays you don't care about our justice system and there's something underneath the surface going on here.
Unless both of those people claimed self defence and it the whole events were filmed I have no idea what point you are trying to make.
Who is the wealthy business man?
That would be a test of the bail decision. If he shows up in court to answer the charges against him, then his bail conditions will be seen to have been appropriate.
Mr. Bento was a demonstrated flight risk, and was therefore remanded. It is a good thing that he was made to stand trial for the death. I think the outcome of the case was fair and correct.
You are missing the point, you claim he could have skipped town easily.
He didn't, he handed himself in.
We have a justice system that lets a pregnant baby murderer roam around for years on Bail, because her presumption of innocence and her fundament human right of liberty trumps the potential negatives.
A Brazilian lad who hands himself in, not so much. Prison for that guy.
something underneath the surface going on here
Knock that scutter on head lad, you are better than that.
Wheres the evidence that they would have been kicked to death?
The stabbing to death****
So the actual crime has nothing to do with bail, i was not actually aware that the guy that turned out to be innocent missed a court date, if he was a flight risk his passport should have being taken away immediately on charge.
one of them was already on the ground ground with broken teeth. Should Bento have waited until he was also on the ground with broken teeth before defending himself?
There is most certainly something going on here.
You can't reconcile the fact that booking flights to a non extraditing country objectively makes someone a flight risk and will guarantee bail conditions will not be approved by a judge.
Zero percent of the time will someone under suspicion of murder get bail if they do that.
I'm not even going to implore you to see sense here, you've got some sort of pet-theory on this case you're working off so I'll leave you to it.
He should not have stabbed a 16yr twice resulting in death. How many weapons did the teenagers have? What injuries did Bento end up with pal?
He was defending his friend as well as himself. His friend was already seriously injured. He is legally entitled to use force to defend his friend.
It's not up to me to reconcile anything, it's up to the Justice system not to take the liberty of an innocent man, that should never ever ever happen.
And if it does the reasons for doing so should be water tight. It wasn't, the man was failed, his liberty was removed for a crime he did not commit. I don't think you quite understand the gravity of that.
There was a zero path to a murder conviction in this case, absolutely beyond farcical.
Now of course if you want to explain to me how the DPP were assured beyond a reasonable doubt that they could get a murder conviction, by all means tap it out.
Maybe one day if this case is reviewed which it certainly should be IMO, we may hear it. But until then given your fervent defence of a gross miscarriage of justice you'll have to explain it in lieu.
My issue is the use of a knife he was carrying for "fruit". My issue is this thread celebrating the death of a 16yr old that everyone is 1000% sure is a scumbag without in ANYWAY knowing enough about what happened.
Can nobody answer the questions what injuries Bento ended up with from the fight?
I am defending Bentos action that were judged to be proportionate and legal.
The point I’m making is that privilege is no protection from facing charges when a death occurs.
If you want an example, look to the Club Annabelle case, where four people from privileged backgrounds stood trial for a violent death outside a nightclub.
I’m not going to get into debating the outcome of the trials, it’s not relevant to this thread. The point is, if a death happens and there is evidence against you, your status isn’t going to save you from having to answer charges.
Thats fine.
None of them were charged with murder, it wasn't a self defence case caught on camera and they all basically got off scott free, from memory.
Hardly the best example is it?
For any of your comparables to be anyway relevant, it will have to at least someway resemble what happened in this case.
I’m not sure that ohnonotgmail is in fact your “pal”.
Would you please dial down the fightin talk.
Boggles in not understandimg how justice system functions shocka. Full story on page 10.
you mean sob they're not my friend? *runs away crying*
Has anyone mentioned the fact that Bento, clearly wanting to flee the country, maybe did, himself realize that he was OTT during the confrontation, and was very scared that he could well go down for murder/manslaughter?
And I am not talking about him believing that he would be unfairly stitched up.
I mean, if he is so innocent, as so many think, and if he really felt that what he did was absolute self defence and justified, why the very urgent need to want to flee?
Ill talk how i want tbh. Pal isnt overly aggressive but perhaps you are a little slow.
So no reasonable answer to the question I asked.
Head in the sand declaration of how justice was served, everyone feels warm and fuzzy.
As you were so.
I dont want anybody to be upset...
perhaps he is smart enough to realise that innocent people can find themselves found guilty. especially in a legal system they are not familiar with. Or perhaps he didn't fancy spending a long time on remand.
It is relevant.
Violent death and suspects identified and sent for trial. You have been suggesting that rich people don’t have to answer for killings.
Apparently AGS and the DPP should've chalked this one down to fair knife fight gone wrong and washed their hands of it.
This may shock and apall Boggles, but in our constitutional order, everyone, including the deceased has a fundamental right to life, scumbag (sic) or not. If that is taken from you in circumstances where someone is bearing a knife,100 percent of the time, every time in those circumstances some sort of charges will flow from it.
Boggles this is crackpot stuff you're engaged in.
