I didn't even cop that it was a Direct Effect qs and just wrote about member state liability :/
I think he's meant to be a generous marker.
I know he's the only marker that comments on legislation and case law not being highlighted (pre Covid at least) but that online system wrecks my head, it's so slow and jumpy etc that I decided (maybe stupidly so) to not bold Cases... Wasted so much time on it for yesterday's exam and at one stage it was stuck on bold for a whole paragraph...
Re EU I answered Institutions, customs duties, direct effect and then panicked and did the freedom to receive services (if I got 4% I'll do well) and did the casenote q 🙈
Panicked when citizenship, FMOP and mergers didn't come up.
Hopefully easy marking 🤞
I was so disappointed when I saw that competition law Q having studied 101, 102, 107 and mergers! Otherwise thought the paper was ok.
I know someone who passed EU on 3 answers so you never know 🤞🏻
Has anyone got equity October 2021 exam paper and report, I have ordered but still not here
Super grateful if somebody can share equity October exam paper 2021
Has anyone an equity exam grid?
They're all on fe1stopshop on Instagram! someone shared a grid a few posts back- should be on the page before this
Does anyone have a sample answer for the 4 friends co-ownership question that seems to come up on the Property exam please? Apparently its due a run. Have other materials I can swap!
If you could let me know what sitting it came up in I'll take a look.
It last came up in Autumn 2018- q8. Thank you!
I don’t have the sample answers for that sitting - mine only go to 2016. Do you know any earlier year it came up?
I do have the examiners report for 2018, q8 was FHP act - q4 was coownership. I’ve sent you report but I don’t have the question.
EDIT - just found the exam paper - 4 friends is q4. I’ve sent you the examiner report. If you can let me know another year prior to 2016 that a similar q. cam up I’ll sent it on to you.
Hey, I have a sample answer to Question 2, 2015 on Co-Ownership - its four people? I'll private msg. you there.
What are people focusing on for Contract? I'm covering:
Also have a little bit of knowledge on co-ownership, but they're my weakest set of notes by far.
Assume this will be more than enough for the exam?
What do you mean findings and co-ownership? Am I completely missing something here for contract hahahahhaha
Jaysus I'm mixing up my Equity and Contract topics in my head haha
Replace findings with intention to create legal relations and forget about co-ownership!
Happens to the best of us!! I've covered much the same except I also threw in Estoppel and left out illegal contracts. Oh and I have undue influence but just going off my equity notes for that
You know that's probably a better idea axing illegal contracts for estoppel so think I'll do the same, comes up more often, undue influence is also pretty straightforward so no harm throwing that in as well! Best of luck with them!!
Equity: safe to leave out constructive trusts and tracing if most of everything else if covered?
Sat mine in October and didn't go near either of those topics but still got on grand.
Does anyone have an essay/notes for reg/unreg land and landlord and tenant that they wouldn’t mind sharing? Will trade
Anyone have a sample answer for Contract law, a question on the possible reforms for privity? Have a sample answer from Griffith college but don't think it's great. Would love an easily digestible one haha
def should be ok even if both came up if a lot other stuff covered
Sorry I know this has been discussed before, but I am still confused as to the current position on acquiring easements by prescription. Is the method which we should use in a problem question the doctrine of lost modern grant? And we ignore the Statutory Prescription Act 1858?
*This quote from online article should answer your question
"How will prescriptive rights be acquired post 30 November 2021?
Claims will be decided under the common law ‘doctrine of lost modern grant’ (which requires a 20 year prescriptive use period), pending a more comprehensive review of the law in this area (which the Minister has committed to carrying out). This means that proof of the existence of a prescriptive right will revert to the use of statutory declarations in support of good marketable title where there is an undocumented right that has been relied upon for a significant period of time.
A longer use period will be required for the acquisition of prescriptive rights against State-owned land (including foreshore) after 30 November 2021; 30 years for land owned by a State authority and 60 years for foreshore."

*Link also states 1858 Act repealed by 2021 Act
But I'm not confident of my knowledge on this and am soooo open to correction or clarification on this topic if anyone wants to wade in.....
Thank you so much! that's great, that article is v helpful
Possible to learn equity in 3 days ?🥴
