Anyone know what is his medical exception?
he is the current Australian Open title holder so whoever wins has to play him in order to win the title off him otherwise he is & remains the holder as he has not been allowed to defend his title. So for the next 3 years if he is indeed banned he maintains the original title holder.? Does he not?
What happens if somebody retires/is injured after winning a grand slam title. Do they keep it forever? Bizarre thought process.
Worth noting that under current rules, he'll have to 'catch' Covid again sometime over the summer in order to play at the US Open.
He won the initial appeal on a technicality because he they had told him he had until 8:30am to contact his lawyers and Tennis Australia but they cancelled his visa at 7:42 am. Nothing else was taken into account when he won that appeal in relation to his visa or vaccine status or how he had filled out the travel documents.
If they had waited until 8:30am to cancel his visa the judge would most likely have ruled against him.
If the immigration minister had not cancelled his visa it sets a precedent for other people trying to get into Australia so as harsh as it is, in the bigger picture he had to cancel the visa to deter other people from doing what Djokovic did.
It's not up to Djokovic to decide how Australia operates it's border and what the rules are. There can't be a system where it's one rule Novak Djokovic and another for everyone else.
The Australian government are muppets. They absolutely are dragging their heels, they know full well what they're at. For the initial appeal they tried to postpone it by a couple of days, knowing full well that would have meant Djokovic missed registering for the tournament, which was rejected by the judge.
This is all about face, politics and winning the next election. More than it is about Djokovic posing any real threat to the Australian people.
He wasn't "got" on any particular reason.
The minister just used the broad ministerial discretion powers.
The reason given to go with it did not claim djokovic had not filled anything in incorrectly or that he was a public health risk.
The Hawke guy said he was
"Protecting Australian sacrifices"
Which is a cop out really
So they couldn't come up with a valid reason basically and are just booting him out
"The Australian Lawyers Alliance has released a statement saying that the government’s decision highlights Australia’s “arbitrary and unfair border policies”.
The main hearing will be Sunday
Desperate clutching at straws.
That is utter nonsense.
Plenty of people have won titles and not been able to defend them due to other factors e.g. injury...it doesn't mean they hold the title for life...
I'm pretty sure I read somewhere this morning that two people who had come in on the same exemption were denied entry and had returned home without challenging it.
Yep, it was here: https://www.rte.ie/sport/tennis/2022/0114/1273619-djokovic-has-australian-visa-cancelled/
(Czech player Renata Voracova and an official)
I don't know about Australia but in Ireland public bodies are prohibited from disclosing personal details about individual cases. That might be a bit pointless given the leaks that have gone on but you can be damn sure Djokovic's lawyers are just waiting for someone to slip up and give them another reason to appeal, and paint him as the victim.
Key point being you doing know
It's a sweeping arbitrary power.
That's why the lawyers alliance put out the statement in my last post.
"the rules of natural justice do not apply to decisions made under s 133C(3). This means that while Djokovic still has the right to challenge Hawke’s decision, he can only do so on narrower grounds. Specifically, his scope to argue that the decision is unfair is reduced."
FMD, this is where we’re at 😂😂😂
A family man who stands up to bullies.
I honestly don't see a visa being revoked for incorrect immigration documentation, regardless of whether it was deliberate or not, as "arbitrary".
Australia are notorious, even pre-Covid, for their stringent border controls.
The only difference here is that most people don't get the chance to appeal in court, they just get put on the first plane home. Djokovic has had far more due process than most people who enter Australia on false pretences.
This 133c law allows for the arbitrary "at discretion of" basis.
It's basically like " you're out, we don't need to prove why, it's at my discretion and I'm saying that it's in the public interest"
"To protect Australian sacrifices" apparently
The last hearing is irrelevant in this regard as 133c was not used and a decision was granted there in favour of djokovic because the border agent messed up on procedure.
Tournament decided by Hawkeye. Nadal will be happy. At least Andy Murray will still be knocked out before end of week 1.
This is a livestream of the court hearing going on right now.
cracked up laughing
Aye
Covid has like everything else in these times become another sphere within which people get to exert their identity.
He played last year and the sky didn't fall in.
The world is not a welcoming place for anyone who doesn't fall in line.
Out of the tournament after only missing 2 shots.
The worst thing Djokovic has done is make ScoMo and the Liberals look good prior to an election. Unforgivable.
The Chinese must love him, deflecting from their policy of allowing senior party officials to have their way with any woman/girl they like.
The Australian government honestly couldn't care less if Djokovic is there to play tennis, visit kangaroo shelters or learn to throw boomerangs. That doesn't even come into the decision around his visa. The only thing they are interested in is protecting the integrity around their visa process. Simple as that.
Jaysus H Christ.
Do you know how sports work at all ?
Also enlightening how one of Novax's big supporters thanked your post. 🙄
You really believe this?
and if true, in this case, it paints them as utter numpties. Arrogant aggressive numpties. With no sense of common sense, fair play, or compassion
Give every unvaccinated person with a family a visa!! 😂😂😂
As the pandemic has proven in regards to Australia and well put by this Clive James chap.
Yes I do.
Have you ever been to Australia? They really love rules and red tape. They would never allow a situation where people are allowed to bypass border rules.
As an aside I don't believe that Djokovic posed a threat to anyone including himself in terms of covid but all that the Australian government can see is that he broke the rules and shouldn't be allowed stay. It really is that simple with them.
Fooking rich dragging in fair play and compassion when discussing Novax Djokovic and his Australian escapade.
Where was old Novaks compassion when he went covid positive to meet journalists, unmask himself and never let them know ?
Where was his compassion when he organsied a tour that basically was a covid breeding ground?
Why does old Novak get an exemption in the first place when others have been turned away without vaccination?
How many others would be straight out turfed out immediately rather than hang around with expensive legal teams ready to mount legal challenges?
No the arrogance has been Novak.
He went on social media and basically bragged how he was off to Australia without vaccination and he had an exemption.
There is no way in hell the Asutralian government and indeed the Australian immigration authorities could allow him stay.
He has given the two fingers to every single measure that authorities and government brought in to try and prevent the spread of covid and thus limit the deaths.
He has given the two fingers to 90% of the Australian population that have gotten vaccinated.
And given the two fingers to the Australian population, with often great personal sacrifices, that have abided by some of the world's most strict lockdowns.
And to top it off he then also gives the two fingers to their immigration rules and regulations.
ok thanks i wasnt sure thats all lot of folks being nasty i was unaware of that.
Roll Novak Roll....
