Anyone know what is his medical exception?
A family man who stands up to bullies.
FMD, this is where we’re at 😂😂😂
Key point being you doing know
It's a sweeping arbitrary power.
That's why the lawyers alliance put out the statement in my last post.
"the rules of natural justice do not apply to decisions made under s 133C(3). This means that while Djokovic still has the right to challenge Hawke’s decision, he can only do so on narrower grounds. Specifically, his scope to argue that the decision is unfair is reduced."
The reason given to go with it did not claim djokovic had not filled anything in incorrectly or that he was a public health risk.
I don't know about Australia but in Ireland public bodies are prohibited from disclosing personal details about individual cases. That might be a bit pointless given the leaks that have gone on but you can be damn sure Djokovic's lawyers are just waiting for someone to slip up and give them another reason to appeal, and paint him as the victim.
I'm pretty sure I read somewhere this morning that two people who had come in on the same exemption were denied entry and had returned home without challenging it.
Yep, it was here: https://www.rte.ie/sport/tennis/2022/0114/1273619-djokovic-has-australian-visa-cancelled/
(Czech player Renata Voracova and an official)
That is utter nonsense.
Plenty of people have won titles and not been able to defend them due to other factors e.g. injury...it doesn't mean they hold the title for life...
Desperate clutching at straws.
He wasn't "got" on any particular reason.
The minister just used the broad ministerial discretion powers.
The Hawke guy said he was
"Protecting Australian sacrifices"
Which is a cop out really
So they couldn't come up with a valid reason basically and are just booting him out
"The Australian Lawyers Alliance has released a statement saying that the government’s decision highlights Australia’s “arbitrary and unfair border policies”.
The main hearing will be Sunday
The Australian government are muppets. They absolutely are dragging their heels, they know full well what they're at. For the initial appeal they tried to postpone it by a couple of days, knowing full well that would have meant Djokovic missed registering for the tournament, which was rejected by the judge.
This is all about face, politics and winning the next election. More than it is about Djokovic posing any real threat to the Australian people.
He won the initial appeal on a technicality because he they had told him he had until 8:30am to contact his lawyers and Tennis Australia but they cancelled his visa at 7:42 am. Nothing else was taken into account when he won that appeal in relation to his visa or vaccine status or how he had filled out the travel documents.
If they had waited until 8:30am to cancel his visa the judge would most likely have ruled against him.
If the immigration minister had not cancelled his visa it sets a precedent for other people trying to get into Australia so as harsh as it is, in the bigger picture he had to cancel the visa to deter other people from doing what Djokovic did.
It's not up to Djokovic to decide how Australia operates it's border and what the rules are. There can't be a system where it's one rule Novak Djokovic and another for everyone else.
Worth noting that under current rules, he'll have to 'catch' Covid again sometime over the summer in order to play at the US Open.
What happens if somebody retires/is injured after winning a grand slam title. Do they keep it forever? Bizarre thought process.
he is the current Australian Open title holder so whoever wins has to play him in order to win the title off him otherwise he is & remains the holder as he has not been allowed to defend his title. So for the next 3 years if he is indeed banned he maintains the original title holder.? Does he not?
they'll probably give him a medal.
I hadn't seen these comments before from Tsitsipas.
He broke Australian immigration law? Do you think some people should be above the law?
It will be interesting to see if the authorities in Serbia do something about him not self isolating while positive...I am guessing their are fines etc?
Because to some he is special and anti vaxers say rules only apply to some people sometimes or some such shyte.
Except did old Novax respect the body integrity of the L-Equipe journalists when he met them, took off his mask in their presence and never informed them he was covid positive ?
It is gas when anti vax people talk about bodily integrity or some such stuff, but they show absolutely no respect for the body integrity of other people who may be very susceptible to a very contagious disease.
Sorry to tell you this Xavi6 your mother is just a pleb, a nobody, she is not the greatest tennis player in the world, she is not a hero to people who think you can change water and food properties by staring at it and concentrating hard.
PS I am sure your mother is a lovely lady.
I have a real dislike for anyone who shows such contempt for the global effort to counter Covid tbh. Beyond that, he is a non-entity to me.
Did we all forget this, btw
Djokovic apologises after tournament leads to Covid-19 (rte.ie)
Read that and tell me the guy isn't rotten to the core.
Ok, so it’s clear your views are based on a real dislike for the man.
None of us know him. I am not a big fan. To me he is just an exceptionally talented tennis player.
I think he had been very unfairly treated here at the end, after taking into account all the facts and all the struggles. To have the rug taken from underneath him at the very last hurdle is wrong.
the minister absolutely did not have to do this. He chose to deliberately do it. And he was wrong!
I don't know what the form looked like in 2016. Did it have a field about being in other countries on your way to Australia? I would also suggest it is much more relevant now than it was then.
Yes, I am hellbent on seeing him kicked out. He is an absolute prick.
I might be thick as sh1te but I'm not a right wing conspiracy nut job so I think I'm coming out OK.
I think the Australian government are making their decisions based on what they believe is the popular opinion of the Australian people.
I do also think they're strategically dragging their heals when making their decisions to make it less likely he will be ready to play when the tournament starts.
My personal opinion is irrelevant. But as I've said, I've little sympathy for him.
I honestly don't get the equivalence at all.
Regardless in this case it is the same outcome.
I agree with what you are saying.
But the criteria they have managed to snag him on existed pre-pandemic. That's my point.
It is like getting him for having fruit in his luggage.
I'm still not sure actually- is an unvaccinated Joe Soap who has had covid in the last 6 months allowed into the country, or not?
It's moot in this case, as the reason for his ejection is the mess up on the entry forms, I imagine (not sure this part has been specifically made clear by the minister).
He should be treated the same as everyone else, but they should have anticipated the media storm by having him land at all. Similar mixups with an unvaccinated pleb would not result in a media frenzy, and they could have quietly kicked them out. So actually what I am saying is, Djokovic is saved travel stress that a pleb possibly isn't.
I mean, technically they could throw him in jail for 12 months.
Deportation is actually a light enough sanction
Who said that?
Him not doing what he did is not condoning anything. It’s using common sense and discretion after all the facts are considered.
and if people can’t see that, then they’re as thick as sh1te in my opinion. Or more likely, just hellbent on seeing him kicked out
Whats happened here is akin to a man suspected of murder being done for not being tax compliant.
The perpetrator is punished but for a different reason to his initial arrest.
