Hi
Can a question come up in Equity in relation to SP and rectification mixed together. If it does how does it usually come up.
Regards
Gus Hayes
For contract are people focusing on any aspect of terms in more detail than others? It’s just so long haha
Constitutional
Does anyone have sample answers for Constitutional? Happy to swap for materials for any other subjects! Absolutely desperate at this stage!
Oh yeah good point, might see if I have enough time for equality to have somewhat of details memorised.
It did run through my mind that those were examined in March paper, my hope were that some aspect would be re-examined as a problem question on expression/assembly would be pretty good (for me anyways!)
They can come up together as a problem question whereby there are 2 parties to a contract and one wants to ensure specific performance of the contract and the other is claiming a mistake in the contract to be rectified, that sort of thing.
SP can always be an essay, usually focusing on Defences or personal services.
For judicial power, has anyone gone through all powers of the judiciary? For example, tribunals, prison rules, disciplinary matters, criminal matters, censorship etc? Or just listed what they are focused on statutory tribunals re zalewski and revocation of citizenship re damache? Running out of time and trying to cut
CONTRACT
Is anyone else finding it hard to study for contract? All of the topics seem to merge and the questions are so hard to identify?
What topics are you all covering and is there anything I can leave out? :(:(
Yeah i find it difficult to study for contract but i feel bad saying that as Constitutional is 10 times worse 🙈 I just find it difficult to identify the topics in the problem question so im hoping for 2 or 3 essays but i dunno - she put up 7 PQs the last time, i would have definitely failed it.
I'm covering
i’m the exact same as this but with resulting trusts.. anyone think it’s safe to leave out mareva injunctions entirely?
I would have said yes but then I sat Property on Friday 🙄😂
me too!! threw me off completely so don’t know what to think now 👎
Contractual interpretation and implied terms have often come up as 2 parts of the same question where you answer one part, so you could choose one of them over the other and hope for the best, although that could be quite risky. Also distinction between contract terms/representations/sales puff has come up in the past and there aren't that many cases there and it's fairly straightforward and easy to understand. The only thing is if a question comes up on breach you really should know how to distinguish between conditions and warranties, as the examiner reports have mentioned that in the past. The thing about contract is there are often 2 or 3 topics in one question so it is really hard to choose what to leave out :(
Yeah I agree! I ended up covering it all anyway just took me far too long!! Struggling to study for this one
I’m leaving out agency, illegal contracts, undue influence and formal requirements! Covering the rest
Same!!! (aside from the fact it was all essay Qs) I wasn't expecting another essay on construction to include EE after pretty much the same Q came up in March! 😭
Hoping equity is fair (well as fair as she usual is LOL) in that she doesn't decide to repeat topics to catch us out. I am not looking at Tracing, secret trusts etc as they were up in March, but that's not to say she hasn't predicted that and intends putting in as an essay... I am suspicious after Fridays fiasco alright🤣🤣
In a normal sitting, is constitutional four problems and four essays?
EQUITY
I am aiming to have learned the following topics (feeling burnt out though so worried if I will be able to learn all)
Purpose Trusts
Express Trusts
Injunctions
Rescission
SP
Rectification
Trustees
Is this enough? I’m really worried about this exam considering the failure rate but with working full time and exams last week it’s been very hard to study.
I would probably throw in Charitable Trusts and Cy-Pres as they tend to come up alongside Purpose Trusts. Cy-Pres is really short but Charitable Trusts are a bit of a slog. Best of luck with it, nearly there!
I have condensed notes for charitable trusts if you need - passed equity last sitting. It's basically what I memorised for the exam, clear and concise. PM me your email if you want!
Only really need Undue influence for Recission if that helps. Also if you're struggling for time to do all of charitable trusts, you could take a brief look over it and then focus on Cy-pres. It's very short and quite easy and definitely due a run IMO.
In terms of FMOP for eu what are people focusing on?
Dont forget case notes
Typically there are 3 Essays, 1 Case Note, 4 Problems. About 4 or 5 sittings ago there were 4 Essays & 3 Problems with 1 Case Note.
I feel your pain, I'm exhausted at this stage and definitely struggling.
Like others have said, rescission can be condensed to just Undue influence. (it has been in the last 3 papers so I wouldn't be sure about it appearing.
I don't think purpose trusts will appear in any significant manner either.
Definitely try and do Charitable!
Does anyone have any tips on how to recognise the issues in a problem question for Constitutional? I am struggling big time I keep thinking every problem question I read is asking about non-delegation doctrine haha
I feel like I should just give up on Constitutional. I don't know anything.
I was told to watch out for a mention of land/restriction of use of land as that usually means he wants you to discuss property rights.
I'm having the same problem but I think if you take a step back and ask what rights are possibly being taken away from this person it is helpful. I'm hoping he gives marks for any reasonable interpretation of questions though once you hit some of what he is looking for because it is hard... there is so much in each problem question but I think maybe that is the point?????
Brain overflowing at this stage 😰 😔
Is there anything people are definitely leaving out for Constitutional? My brain is overloaded and I still have loads to get through. Its going to be an all nighter I think.
Finding this super difficult too, reading questions and not picking up on the topics at all! Praying there will be some nice essay questions I can lean on!!
