I dont have the paper but this is what someone put up on boards last year after the exam:
Q1 - was a PQ on Offer and Acceptance with an Advertisement and S. 13 and S.14 of goods being merchantable quality.
Q2 - was PQ on undue influence and a bank as 3rd party
Q3- was a PQ on frustration of a contract
Q4- was a PQ on damages and mitigation of loss
Q5- was a PQ on consideration with a contractor with some economic duress, estoppel and privity
Q6- was a PQ on misrepresentation, an exclusion clause and s14 sale of goods act.
Q7 - was a PQ not sure
Q8 - Essay - EU regulation on Irish contract law or Essay of mistake
CONTRACT:
I'm not sure Consumer Protection will come up again but im covering a bit of it as its handy for Exclusion Clauses etc. I dont have notes on the 2007 Act but i've good notes on the 1995 one. Would that be enough or do i need the 2007 one? If so, willing to trade someone!
I sat & passed contract in the last sitting and would personally take the view if Consumer Protection always being top priority. It is nearly always its own question as well as fitting in to additional questions. So always worth having a half decent knowledge of in my opinion.
Thanks a million for this.
I have learned the relevant sections of the 1893 and 1980 Act - so S12 implications, and S13, S14 and S15 and the cases for each. Then the EU 1995 Act as well. So i'll touch on the 2007 Act too. Do you think that's sufficient?
my manual doesn’t have anything on 2007 act!
She does like to ask it alright but i don't think mine does either. I'll ask around as a few friends have sit and passed - will send you on stuff if i'm successful! :P
i better have another look over the papers don’t think I was paying enough attention hahaha
Whats the pass rate for equity?
Does anyone have any experience with the EU marker? everyone says he looks to give you marks wherever possible
For Constitution, when referring to judgements in SC.. ie "Denham J discussed", etc. would it be any harm just making up who you think said the comment even if you have know clue who said what? Idk, the alternative to me is constantly saying "the Court", which is repetitive.
I was planning on not taking the exam the night before and was literally laughing to myself as I was typing one of my answers and I passed! You'll be more than able! very easy pass imo, best of luck :)
Have only ever heard very positive experiences with his marking. Do read his reports tho for the usual things that he expects like highlighting cases etc
Not great really. It tends to hover around 60 - 65% but one year it went down as low as 48%. The statistics are only available up to 2017. If you go to the City Colleges NBN's at the start of the video he puts up a slide showing the pass rates for all subjects.
Hey guys, probably a stupid question but when a contract is void on public policy grounds this is referring to void contracts right? Contracts that oust the jurisdiction of the courts, contracts that subvert a marriage and contracts in restraint of trade? TIA.
What are everyone’s main topics for constitutional?
It was a lazy way out for the examiner imo. they aren't the worse essays, as their wasn't much of 'critically analyze', it was more of give your own opinion. He set a paper a while back and it was weird so maybe he has gone a lot easier this time. I wouldn't worry to much about the marking.
I would stick with saying the ‘Court’ even if it feels repetitive rather than taking a stab in the dark on who actually said it!
I'm hoping this is true , really struggling to retain info at this stage!
Hi all - has anyone sat the exam in person? Email said be there for 9 and go straight to your seat but then if the exam doesn’t start until 10 that hour would be torture - can we go in closer to 10?
does anyone have a constitutional grid they would mind sharing mine is a bit crap
Thanks :)
I didnt give myself enough time to study the bare min in March but gave it a go. Only answered 4 questions (the one on institutions I lifted literally straight out of the book). Managed a 44. I was actually quite impressed with myself, but yeah he's just a gem of a marker.
Totally agree, they could have been a lot worse! I just find the problem questions are easier to pick up marks on! And time -wise, I just feel personally that essays are more time consuming!
I did it in November and my exam was so so bad laughable thought for sure no way I passed
got 63%
I second this, passed with a high mark even though I wasn't very confident in my answers!
CONSTITUTIONAL EXAM
What are people focusing on? I have:
Would this be enough? Am I leaving something important out? What are city colleges/lawschool.ie predicting?
Im leaving out association/expression/assembly and including in family/education and equality, think they are due a run hopefully
what are people focusing on for equity?
im thinking :
injunctions (mainly mandatory/QT)
sp + rectification
charitable + cy pres
Strong v bird
DMC
3 certainties
prob q for Trustees
basic knowledge of prop estoppel & ui
is that enough?
Constitutional
Thoughts on these topics? Too few or too much?
I'm exactly the same only considering
Presumed Resulting Trusts too.
