That's what i did! I went back through old 'Intention to inflict emotional suffering' papers this morning and it seems like it might have been the right way to go. If it's an intentional and not caused through negligence, which is what happened to Molly (a prank) then it's a trespass on rights - if they're a first hand witness to an event caused by D's negligence (a car accident etc.) then it's nervous shock - a third party claim. So that's why i went down the road of Wilkinson V Downtown and applied the 3 elements in OPO and Roads. You still need proof of a psychiatric illness to satisfy intention to inflict so i was confident enough approaching it that way. I think to be honest, cos Tort is marked so nicely, either nervous shock or intention to inflict will get you marks if you argue your case well.

Sorry for the persistent questions! I’m very confused as to the remedies in misrepresentation. In my book it says the two remedies are rescission and damages in lieu of rescission under SOG act 1980. However other notes I have received say that you can have rescission and damages (which are not under SOG act). Could anyone help? Sorry such a silly q!

Accidentally opened my downloads tab on my browser while typing and it remained open for exam (unbeknownst to me, I didn't even know how to do that before this exam haha)....Wonder will this be an issue considering I swore at the screen for like 30 seconds and stated what had happened outloud
Also v cautious of the fact I was looking down at legislation a lot! Has anyone experienced being flagged for this before? I held it up every so often but not always on the page I was on I'd have to flick quickly then when I put it down too

Yeah come to think of it you're actually right. Nervous shock is only when negligently caused. Kicking myself now because I considered answering it on infliction of emotional suffering but settled with nervous shock. Was just thrown off really because of intentional torts being asked on the question before it. I really hope he gives marks to those who answered on nervous shock...
If you are worried about the opening a different page no harm flagging it (by email) to the FE1 section, so you have it to fall back on if any issue arises down the line. I would say it won't be an issue but better to have the email if you need it in the future. Previously, in one of the sittings my email opened automatically, nothing ever came back on it as I closed straight away.

Hopefully he does, I looked at nervous shock, mentioned intention harm and don't know what I was thinking with that question but I even looked at her employers liability for stress, bullying and harassment and competent employees. I hope he is a really nice marker hahahaha.

I was very surprised not to see Corporate Borrowings had put a lot of time in to it. At least SLP came up!!
Oh listen we definitely passed don't worry. In his examiners report he always says that "this question could have been approached in a number of ways" so really pay no mind to it - nervous shock or infliction will get you marks...and obviously i am far from an expert so they could have been looking for NS!
He's a really generous marker. I answered the Causation question as 99% DOC and SOC and the tiniest bit of causation cos i was so stuck for a fifth... i'm not even that worried. So we're good! Onto the next one now! :)
I thought it was a fairly decent paper. I think the essays in particular were really fair- he didn’t narrow the scope as much as he has done in other sittings. I was afraid the titles would be really restrictive and I’d be left clutching to bulk out my answers. Also yes, surprised by some of topics omitted!

I was a little surprised to see SLP again. I was banking on authority essay too a bit. I think I’ve 3 good answers in there with 2 very basic so I’m hoping that’s enough to get me over 🙏🥴

Very surprising borrowing wasn’t on it at all
Was pretty disappointed with the paper overall, very unsure of how I'll have performed!
Definitely expected corporate borrowings to come up, especially crystallisation of floating charges, also wasn't particularly fond of how the minority shareholder protection question came up & much preferred the problem questions on the previous exams.
Haha yeah you're right no point dwelling on it now. Just gonna put it out of my mind, nothing I can do at this stage. Thank you for the reassurance!!

You definitely did much better than me anyway only talked about nervous shock didn't even mention intentional harm or employers duties. Honestly though thinking back competent staff and bullying definitely were relevant and she could have had a case against her employers for that. Seems as if a good amount of us answered on nervous shock anyway and the examiner is supposed to be reasonable so I think (hope) that we will still get marks for answering on NS!

How important would others think it is to cover Oireachtas (functions, elections, rules, etc) for the upcoming Constitution exam? I haven't the time for it...
I believe that if the misrepresentation was innocent then the court can award rescission or damages in lieu of rescission. If the misrepresentation was fraudulent or negligent then both can be awarded!
I know these 5 came up - SLP, minority shareholders, realisation of corporate assets, restriction, DD common law and statute and I think Table A/constitution Hopefully someone else can tell you the other two.

Remedies (damages etc) and discharge (frustration/breach) usually come up!
Thought it was a nice paper. Nice question with duties and restrictions. Nice question with share transfer and minorities. SLP was decent, based on an English Supreme Court case from Feb (Okpadi I think). Other 3 were ok but didn’t cover enough, happy overall!
