The biggest craic will be another bill going into Congress, that DC can become a 51st state IF it allows open carry and becomes a 2a sanctuary state!!!:D:D:D Its being proposed by some of the pro-gun congressmen.

Guam ,not so sure,it might tip over and sink at any minute if there are too many people on it according to Congressman Hank Johnson [D]

Definition of a Liberal antigun conundrum.

Only the police should have gun, as they are properly trained and competent to use them.

The police are shooting black people and kids all the time!

Completely justified police shooting i would say. Unfortunately the girl died from injuries sustained. But definitely a life saved by the officer too

Yep, looks like a horrible scene to rock up to, but I don't see a less-lethal way round it, that was a fairly serious knife attack underway. One big difference at this case to Chauvin is how the police made a real attempt to provide medical assistance.

There are echos to the tragic case in Ireland a few months ago.

Should Floyd have died? Absolutely not. Was Chauvin at fault, yes, but not for 2nd degree murder. I don't believe there was intent let alone enough to be found guilty of all three counts (must look up how someone can be guilty of murdering the same person three times/ways).
None of the charges involved intent to kill. That seems to be a massive misconception that people have - possibly based on our own legal definitions.

The reason he can be guilt of multiple charges related to one crime is the legal concept of an "lesser included offense". Eg The larceny is less severe than robbery, but robbery by default includes lacerny.

On a practical level, only the most severe offense stands. He'll be sentenced for murder 2.
    Cass wrote: »
Both and 3rd degree murder. The first two counts must show intent (2nd degree murder and manslaughter) whereas 3rd degree murder does not require intent only the end "result" if i'm reading the verdict right.

    The charges were;
    • Unintentional 2nd Degree Murder (malicious actions without intent to kill)
    • 3rd Degree Murder (reckless discard for human life, no intent to kill)
    • 2nd Degree Involuntary Manslaughter (Reckless behaviour leading to death)

3rd Degree murder is only used in a few states. Based on the definition this fitted the bill of disregard for life. He maintain the position long after he needed to, even though he was trained not to, and even after the other officiers called for medical attention.
    [/QUOTE]
    Grizzly 45 wrote: »
Some of those charges are somewhat hard to understand and require some knowledge of the US judicial system to make sense of... or not...

3rd-degree manslaughter... EG Would be you go to a bridge on an overpass and lob a breeze block over it onto traffic without the intention of killing a particular person, just for the Hell of it,but hit and kill someone with it.

2nd-degree mansalughter. You go and rob a shop with a gun, and the gun accidentally goes off killing the shop keeper.

1st-degree manslaughter, you get into a fistfight and knock the other guy out cold, but because your blood was up you kerb stomp his head until his brains are coming out.

Hence the "degree" terms in US law for seriousness of crimes

So maybe you can sell the 2nd degree manslaughter charge by Chauvin kneeling on Floyd and not rendering proper assistance to allow him to breathe properly. But I cant see where 3rd degree comes into it.
3rd Degree manslaughter wasn't one of the charges though.

I agree it's a complicated system, further complicated by the fact that it's up to state law. Minnesota is one of the few with 3rd degree murder.
As above, the manslaughter charge was labeled involuntary.

    Ah.

Sky news said murder 2 and man. 2 had intent "built into" them. As said above that is where i got my definition from and why i said i could be wrong so thanks for clearing it up.

On the murder 2 being malicious, but not having intent. Thats a fine line is it not? If you had malicious intent then surely that is the intent to do harm. Is it that intent to do harm stops short of being intent to kill under the definition of murder 2?

Just looking up the various terms.

I knew from watching tv cop shows (although not a great source for info) that manslaughter "in the second" (as they say) was murder without intent to kill so that one seemed odd at the time and judging by what you're saying is so. 1st degree Manslaughter o the other hand is death through an act of intent but not rising to the level of murder because of its "moment of impulse" factor/clause.

Now second degree murder is listed as a killing that is not premeditated but is intentional.

3rd degree murder has a lower standard than 2nd degree and you need not show intent merely that the actions of the person involved caused the death of a person.

Yeah, it’s very confusing. Added to the fact that about 40 of 50 states don’t have murder 3. Murder 3 in a lot of places, would be a version of manslaughter.

Murder 2 can be an intentional killing in a fit of rage (as opposed to aforethought).
But can also be unintentional killing, but with deliberate malice.
The latter not very different from voluntary manslaughter - where you intentionally act, but didn’t mean to kill.

I’m curious about the sentencing. I wonder does the fact he was willing to plea stand to him.

That, it being his first "offence", his service as a cop, etc. Some are saying he'll get max of 12 years if that.

Of course there is the long process of appeals and they will come.

I still maintain the trial was a disaster, fraught with problems of witnesses, judicial issues, pressure over the case, political input and interference, etc.

It does,as it gives the court less of a workload on the case and allows your lawyer wriggle room to plea bargain your sentence time if you plead guilty to lesser charges.

Someone should compile the attacks on climate deniers (bona fide climate scientists who disagree with the prevailing narrative).

Here's one from 2017 that's been forgotten - shots fired at the offices of two deniers

And the list of climate scientists who have been professionally boycotted/cancelled for refusing to toe the line is really something to see.

Similar happened here in regards to Prof Ray Bates who was shouted down by one Eamon Ryan on Prime Time a few years back when he attempted to explain the obvious flaws behind the climate hysteria - sadly since then climate science has continued to be dragged threw the mud to the point that that the mainstream media now consider the likes of a random Swedish child with special needs more worthy of air time on the subject then people who actually know what they are talking about!!

Very few are willing to sacrifice their career for the sake of science.

    The really good ones will.

The facts will eventually come out, hopefully we won't have to wait as long as poor old Galileo.

Everyone should see what they are doing to the historical temperature record - they have "adjusted" it to the point that the climategate emails have gotten what they wanted.

I heard the other day that they have started to "adjust" the satellite temp data.

How long can the farce continue until smart people look out their windows and wonder where the abnormal floods and fires are?

Just because you have a "professor" or" Doctor" in front of your name doesn't mean you are qualified in the topic of climate change. I'm sure a few that signed the Extinction Rebellion manifesto Ireland in 2019 have worthy studies in the fields, but somehow I doubt being a professor in Jazz studies and modern dance,or gender studies is a relevant field to this topic?:P

I remember as a nipper in school in the 70's and 80's, being told by the time of the millenium, that the global ice caps would be long gone and half of Ireland would be under water. Last time i checked, they were still there and thats over 2 decades ago. Anyway, most of the dirty work, manufacturing powered by coal plants etc is done in China and other asian countries now, they are not going to strangle their economies to keep a few middle class looney lefties and grotty thunberg happy.

The stop was a setup by DHS. Apparently the unfortunate patrolman wasn't told anything about who he was told to stop!

If DHS was that involved in this and didn't inform the officer properly on how dangerous this character was, well then they are responsible for his death as well, and if they shot him further on down the road after this shooting,in a contrived ambush, well that is then an execution without trial by DHS. which is rather worrisome,as that will give them in future zero cooperation with local PDs. Who might object to being Federal sniper bait.

Apparently like he had already seen it. So I think you are right that het was unfortunately careless.
After walking over to the passenger-side window of Cueva's white pick-up, footage shows the officer saying politely: 'Good afternoon, sir. My name is Darrian Jarrott. I'm with New Mexico State Police. The reason for the stop is your window tint is a little too dark.'

Jarrott, a father of three small children whose partner was pregnant at the time of his death, says: 'Yeah, mind if I open the door? Or if you want to roll down the window more.'
In a brief conversation lasting around three minutes, the officer asks if Cueva had insurance, to which he replies 'yes', and confirms his name, before asking the criminal to come over to his patrol car so he could run checks.

Cueva opens his door, at which point Jarrott notices his rifle and asked, 'You have a firearm on you, do you mind if I take that off you, for my own safety?'

The officer then says, 'Let's go to my vehicle OK', at which point Cueva gets out from the driver's seat holding the rifle - which Jarrott is unable to see because his view is blocked by the pick-up.

Completely agree that they are responsible for his death if a Federal agency put him in that situation.
If the news report I read, it mention DHS was first on the scene. If made it sound as if it they happened upon them. Has it been confirmed or just alleged it was a sting and not a routine stop?

It looks like it was local PD who shot the guy in the end. The fled for 40 miles or so. State Police, Local Police Department, Sheriff's Office, and Border Patrol all joining in. Presumably it was in the region somewhere close to the border.

2am - Not staying up for it, might catch a little, but i see on the news biden is about to address congress. Will have to catch all the "highlights" tomorrow but the introduction of the news broadcaster is laughable so this can only be gold.

2:03am - pelosi actually drooling over herself so this can only be worse than, reports from, the mastabatory show that was the oscars.

2:06am - One quick thing though, he said "............. truth over lies". Nice to see someone told him that is the correct way to say it instead of "truth over facts".

2-16am - Right, thats enough. Joe is already off on his "come gather round the fire children, uncle joe is about to tell a story of hope, Unicorns, and fairy farts".

The stimulus package they are applauding is a joke. Another 1.8 trillion for a self imposed, artificial, recession. Open stuff back up again and it'll naturally come out of it without the need for hundreds of millions to tens of billions going to foreign countries, national galleries, and other special projects that have nothing to do with keeping the economy going.

Fair play to President Biden, only 100 days in office and he's doing a great job. He's making America great again after the last imbecile nearly ruined it.

LOL. The first point in the article is literally that two people (neither of whom are Joe Biden) who were present at the speech..... have vaginas.

    Fair play.

Did we ever think we'd see house prices rebound so quickly after the Celtic Tiger, especially considering the global pandemic of the last 12 months?

Tough times for people living at home with their parents or renting and trying to save to buy their own place.

I'm not sure if you are being sarcastic or not.

Yep, the last lad was an imbicile but I don't see Biden as having done much in his first 100 days.

One cop in jail and he has rooted out systemic racism. Aye......

The border situation is actually worse than under Trump but the media aren't half as focussed on it as when Trump was in power.

I'm not a Trump fan but here's how the media would portray the same event:
Trump puts in place $1.8 trillion stimulus package = Trump has saddled us with debt.
Biden puts in place $1.8 trillion stimulus package = Great man helping the American poor.

    Biden ain't 'all that'.

I do have a wry grin on my face when I see lads on here arguing the toss on US politics, like it matters, they're all gangsters out for themselves.

I'd be more of an Old Testament, an eye for an eye type myself. However do these bible bashers not forgive and forget?

The writer probably needs some English lessons.
An attack on democracy is not the same as an Attack on the country. I thought that was fairly obvious.

Pearl Harbour was an attack on America. Not on democracy.

Not being sarcastic, I am of the opinion he is doing a great job.

Admittedly the bar was set as low as it could go before he took over but that doesn't detract from the great work he is doing.
