Derek Chauvin murder trial (George Floyd)

Muahahaha

Officer Derek Chavin goes on trial today charged with the homicide of George Floyd, if found guilty he is facing up to 40 years in prison.

The prosecution is largely based on the 9 minute long video of Chauvin pressing his knee into Floyds neck. The defence is going to claim that Chavin did nothing outside of his police training and that Floyds death came about because of drugs in his system and an underlying heart condition. The official autopsy found that his death was a homicide.

Witnesses include a then 17 year old girl who filmed the video on her phone and a police dispatcher who watched events unfold live on CCTV and alerted her supervisor about his treatment.

Its unknown if Chavin himself will take the stand. The trial will also open up answers about the previous relationship between Floyd and Chavin- they both worked as security together for a bar in Minnesota. The trial itself is expected to last 4-5 weeks. The other three police officers involved in the incident will face trial themselves in August.

When Trump commented on it, on national prime time television (most watched show in news incidentally and tragically) there hadn’t even been a grand jury empaneled; he had tainted the entire county pool of jurors.

Biden affected no juror in this case by this means.

Correct-but he’s also setting high expectations of the jury and their decision in a greatly inflamed and divided nation- as president, by saying the evidence is “overwhelming” is another way of saying, “if this guy doesn’t get 2nd degree murder the riots that will follow will be somewhat justified and understandable”- that’s essentially the sub-text of what he’s saying as a politician and how it will be received by his followers.

He should keep his damn mouth shut right now as there are very simple minded people out there, as we’ve seen in Trump-land, who hang on the every word of their president and will do lots of nasty things thinking they have the backing of their man in the Whitehouse.

11 hours is not a quick verdict as many are saying. average jury delibration time is just two hours.

He took very unorthodox approach here. To be fair, I've seen it the other way before too, where the president/governor etc etc will come out ahead of the verdict and make no indication of bias, but will urge calm etc. and you'd think 'yeah nothing wrong with that' but even that can still be interpreted to people who are going to riot regardless, as a reason to riot, because they think that means a fix is in etc.

In this case nothing in the act prejudiced the case, and, if he's found not guilty, in light of Bidens unorthodox action people will be referring back to him tonight to see what he says next, now, knowing that he was 'on their side' so to speak, or at least thinking he was.

Nothing justifies violence and criminal actions if they occur

I reckon it'll either be third degree or manslaughter. He'll be looking at between 5 and 12 years in prison based on Minnesota sentencing.

I can’t see a murder 2 verdict- what do others think?

I’ve changed my mind on murder 3- I think it’s a definite possibility having read up more on the definition as opposed to manslaughter- I think manslaughter is a verdict designed for a much more straightforward accident coupled with some negligence - this was more than that IMHO- but I still don’t believe the prosecution proved murder 2 beyond reasonable doubt

Laws as written don't really stick a murder 1 or 2 IMO. Murder 3/manslaughter yes, subject to the defense and prosecutions cases.
