It really confused me during the exam as I then felt I needed to separate them out, but definitely gave more weight in my answer to adv/disadv. Usually they would state it was separated for equal marks, but putting in the (a) (b) was really misleading then if it wasn't. I've emailed the LS about it but curious if anyone else thought the same.

I thought this was a funny one too - had never seen it set out like this in a past paper before. I didn't want to repeat myself so saved SLE for part B and talked about it there and then just kinda expanded on Part A! But agreed I was a bit miffed with it too

I was advised if we were unable to get the legislation due to the opw closing we could use a print out. That was for the property exam.

I agree. I have the same covered pretty much. Capacity too instead of intention to create.. also did privity since it was short enough

Glad I wasn't the only one! It really threw me off. I've emailed to ask them to bring it to examiners attention, bad drafting of a question at the very least and if it affects our marks then even more so.

Ive been advised by the prep course im taking that tracing is definitely due a go this paper, its more or less a similar question that's asked so its handy to have prepared - trusteeship is also important so IMO I would have both ready - tracing is essentially a small piece on the intro and rest is spent discussing the 3 'rules': rule in Foskett v McKeown, rule in Roscoe v Winder and rule in Re Hallett's estate and briefly on Innocent volunteers - at most will take an hour to do out. Again, its not guaranteed but if its like previous papers, its 'likely' to show up

I have been practicing some equity questions. I find that there is a lot to write about in all of the questions, in comparison to other subjects. I’m worried about timing. Is anyone else feeling the same?

yes im exactly the same - for me I just make sure I get all the main points down, and address the more pertinent issues/caselaw first because that's what will get you the most marks. Make sure you time yourself and don't go over the time in any one question since with will eat away at the marks for other questions. Don't treat these like college exams - its mostly a broad understanding and concise explanation.

that's why I didn't understand why they took so long to find an online 'option' that protects integrity of exams - you could have all the notes in the world, if you haven't prepared and don't have a sufficient understanding of the topics there is 0 hope of getting 5 questions done in 3 hours

Im also doing the Defences to SP

For tracing ive studied it like 1. where money is mixed with money of fiduciary, 2. mixed with innocent volunteers and when trustee mixes money of2 funds - rule in clayton is this incorrect approach?

I thought build/repair was included in contracts for personal services and the general rule is that the court will not enforce such contracts where they require inappropriate levels of court supervision?

our prep course told us those are important in addition to the others - 3 rules in total. See my post on previous page

When I seen that I initially thought it was to do with his examiner reports - said that that question is normally answered by people just talking about SLP and not mentioning any of the other consequences of incorporation (limited liability/enforcement/perpetuity)

SP is a bit all over the place as far as I can see, but it seems to come up two ways: (1) an essay on contracts for personal services (came up in Oct 19); and (2) a problem question that combines (a) rectification due to a mistake; and (b) a counterclaim for SP (March 19). On the basis of random appearance then you’d assume the latter will be how it is likely to be asked if it appears on Tuesday.

So, to be covered for SP you’d need to have rectification and common/unilateral mistake done too afaik. That’s just what I can see from the exam papers anyway, but could very well be wrong!
