The truck driver didn't get up that morning and go I'm going to kill her.

Ridiculous sentence to be honest.

Very sad case and I feel bad for all it's affected.

There are many reasons why he may have missed the car such as extra spray off other vehicles, rain was even worse at them few seconds, anything at all could have changed.

Contributed to is a better term than caused here.

Please folks - heed the recommendation. Get out of the broken down vehicle when safe to do so and get behind the barrier. Even if it is dark and rainy you are better off.

but in fairness, the Garda investigated and the DPP felt there was a case to charge him with careless driving

he also pleaded guilty to careless driving

I doubt he decided that himself. I'd imagine his solicitor told him it was his best shout.

Like it or not, theres a serious issue in this country with "dont speak ill of the dead" , regardless of how stupid their actions were.

I had false allegations made against me and the dpp put it forward and was in court 4 times over it.

The Gaurd which I never met or had any dealings with me was the one that brought me to court and made false statements and also copy and pasted 2 of these and one witness on my side was given a totally different name on his actual statement and never told of the court dates.

I was extremely disappointed with my solicitor as he put off bringing this up and ended up costing me a fortune and days off work and a missed holiday paid and all for.

I have absolutely no problems backing my claims up and have all statements from both sides.

The Gaurd I did deal with was meant to be on CCTV duty that day but somehow was outside and then produced video footage of the exact spot the incident happened but 20 minutes after the fact.

I am so disappointed in the force and dpp over it but have to take each one as they are and hope the corrupt ones are found out for what they are and they are scum.

No but he was advised most likely.

Very unfortunate for both as his life is ruined also.

Please don't get me wrong if he of course fcuked up then he needs to be punished and rightly so.

It's more so maybe something could come from this where it's used to educate and hopefully save others.

Best example is look at the USA police and the amount that are hit, taken out and these have a serious set up of LED lights all over their cars but yet are still not seen day and night.

People are tired, distracted, don't react quickly or as good as others etc etc.

Driver training on motorway use as part of the test should be in place.

At 30 metres a second, (assuming he was driving at 100 km an hour) you're on top of something very quickly . Especially something like a lone car campletely stopped . Its totally unexpected. Heavy rain will only add to that. Even if he had seen the hazards it probably would have taken a couple of seconds to realise it wasnt in the hard shoulder, then he's to try stop a truck in the rain..........

Said woman was sitting in a broken down car, in the over taking lane, in the rain.

Neither the 160kph driver, or the truck driver deserved prison, and the truck driver will be haunted by it for the rest of his life. He has possiblly also lost his job, and livelyhood, due to the four year driver ban, and will probably never drive again anyway even after the four years is up.

Harsh on the truck driver..I feel he has suffered enough, the 4yr ban is totally life changing for that guy. No mention of drink, no mention of speeding, no mention of phone etc.. nothing,, just a terrible accident that could happen to anyone in those particular circumstances and weather conditions.

It's a tricky one if broken down on a motorway on the overtaking lanes.
The advice given is 'if you cant, for whatever reason, move into the hard shoulder, stay in the car with hazards and call the emergency services'.

She could have been disabled / unable to move quick or feared she could have been killed trying to cross over to the embankment with such poor visibility in fairness.
The onus is on other drivers to see any obstacle etc... which other drivers did report seeing.

Still, it's an awful case.
If highlights the dangers of driving that so many of us take for granted.
