The AA also finds it unacceptable that private clampers and the landowners who are their clients present themselves as being of equal legitimacy with clamping that is carried out under the direction of the local authority. They are not.Signs frequently mention a parking ‘fine’ for example. A fine is an amount of money paid as a penalty for a criminal or civil infraction and may only be imposed in accordance with the law. A car owner who parks on private land where there is an implied right of access, such as a car park, cannot be held to be in breach of the law. The motorist might be held to be at fault in a civil matter with respect to the limitations that the land-owner has declared for allowing access to his property; then again he might not and it could ultimately require a civil action to rule on the matter.

Prob two things will result.from it imo. 1 - people who would never vote for Sinn Fein still never will. 2 - due to the thread being dropped into AH with its higher traffic flow, a lot more people now may be aware that private clampers have as much legal clout / jurisdiction to put a foreign object on their car as a goat in a wet suit has - ie none. Just dont park like an arsehole to begin with, and you should have no problems. However if you come back to discover some clown in a high vis jacket has placed a device on your vehicle that is preventing you from moving, please think twice about making a payment to the company responsible, more often than not they're skirting around the ages of what is considered legal anyway, with an appeals process that is a sham and exists only in name - so even if you have done nothing wrong you're very unlikely to get your cash back. Even calling them up to give a credit card payment means calling a premium telephone number where your charged an exorbitant amount per minute plus another exorbitant amount masked as a "card fee" because you paid by card (how else can you make a payment to a machine over the phone?) Remove the clamp yourself, or call a friend or family member to help you out if you don't know how to. Here's a helpful article from Micks Garage.ie that gives detailed instructions on how to go about removing a clamp. In thr article organisations such as the AA say the following about clamping: Just bear in mind that state bodies such as councils etc can indeed legally clamp you - but at least you have a proper and fair appeals process to go through should you feel you have been clamped in the wrong. Don't forget to send the OP A small token of thanks for creating this thread and inadvertently get that message out there and maybe preventing you from parting with your hard earned cash. /raises his mug of coffee to Brenner.
Major fault is the assumption that folk have the time and inclination to get involved in standoff’s in car parks. Only water protestors who get up at 6am to prevent installation and go on marches would seem to have that kind time to spare.
