Hi all! We have been experiencing an issue on site where threads have been missing the latest postings. The platform host Vanilla are working on this issue. A workaround that has been used by some is to navigate back from 1 to 10+ pages to re-sync the thread and this will then show the latest posts. Thanks, Mike.

Seanie Fitzpatrick's trial postponed!

    Has today's postponment of he's trial now set a precedent?

    Can other people facing trial now ask for there trial to be postponed indefinitely citing bad publicity?

    Can the two cousins that were charged with burglary of a house in which the home owner died now apply for the same postponment. As the publicity surrounding there case is pretty awful aswell.

    This has always been the case. But the courts have always been slow to entertain it.

    So another exception for seanie Fitzpatrick, why is the law slow to make these exceptions for anyone else?

    its all about who you know I suppose?

    And can someone explain to me how he's living in a plush house in Greystones, and yet has a small army of a legal team paid for by legal aid!

    And why hasn't the judgement been published?

    This stinks!

    Within the court system, everybody is entitled to a fair trial which is free from bias and influence. This includes the likes of ex Anglo Irish Bank staff, shock horror. Trials have been halted and even collapsed due to media reporting in the past; needs must I guess.

    Legal Aid exists to ensure that a fair trial and a decent defence is available to all of us. When it comes to serious crimes its available to pretty much everybody; where one lives or who you are doesn't come into it.

    The most interesting part of the postponement is the length...it will not be just AFTER the General Election.
    This won't end with a satisfactory outcome for the public, otherwise before the election would have been preferable.
    We still haven't been given any explanation why Mr Fitzpatrick was not prosecuted in the recent trial regarding the hiding of certain bank accounts relating to his relatives.

    3 of his staff get jail for acting unlawfully in hiding dealing relating to Fitzpatricks friends and relatives yet séanie is in the clear.
    This country is a mess.

    You can bet Sean has plenty of dirt to be thrown, should it need to be.

    But it won't come to that and everyone knows it.

    It'll be delayed further until the public have basically forgotten it and rinse repeat for the next lot.

    surely it's better to address the adverse publicity now rather than it being used to appeal any future conviction/s?

    I must admit, I really enjoy visiting this forum for the rational and considered legal opinions, it makes such a refreshing change from the conspiracy theories rampant in other sections of the site.

    It is in the very nature of adverse pre-trial publicity that only high-profile figues will be seriously affected.

    As far as I am aware FitzPatrick is instructing only two counsel.

    Legal aid ordinarily relies on income, not fixed assets.

    It would be(/ can be) very inappropriate for an individual to be expected to ruin themselves in defence of criminal charges.
    And why hasn't the judgement been published?
    A short delay in publishing a judgment is perfectly normal.
    This stinks!
    It smells quite normal.

    What was the story with Haughey's trial deferral? Were the DPP supposed to come back to apply to try him when he thought the adverse publicity was low enough to give a fair trial?


    I presume someone can't defer their trial and defer it again and then try get it stopped due to the long time since the events happened....

    Would it be fairer in your view if the court ignored the established law and set aside fairness so that the trial takes place unduly close to the last Anglo trial?

    And yet one judge insisted on the trial going ahead, another refused to adjourn it indefinately but put it back 8/9 months, and the politicians are keen to have the trial conducted as quickly as possible.

    You seem to think the very worst of the judiciary and Politicians when in fact they are trying to ensure a fair trial in accordance with established law. Thats constitutional democracy in action.

    I believe that was the plan but he fell ill and the prosecution was effectively deferred indefinitely.

    For those who don't remember, Mary Harney stuck her two feet into it by saying Haughey should be convicted and jailed, this was considered grossly prejudical so Haughey got a postponement which turned into a 'get out of jail free' card.
