Maternity Leave Question

    Hi posting this on behalf of someone else.

    Girl in question was the manager of a high street shop (dont wanna give the name but its one of the big ones) and went on maternity leave. During the maternity leave this chain closed down and the shop she worked in was closed. She was not given any redundancy and now a few months later they have opened the shop again. She has now been told that she has to sit an interview for an assitant manager post even though she was manager before the maternity leave. I know that they are not allowed to demote someone when on maternity leave but now that the shop has closed down and reopened is there someway there they could get round it there? Also giving that she was never offered any redundancy and other staff who worked there were we were thinking maybe they knew they would be opening back up and therefore she should be brought back in the same position.

    how long was she working with them?

    if less than 2 years up to the date of her leave then she is not entitled to any redundancy pay anyways.

    as for the rest if the company went into administration etc but then reopened as a new company regardless of new or same shop then her maternity benefits are nil as they were with the now ceased company.

    she was working there for over 2 years so should be have beeen entitled to it, the shop closed down and then was reopened by the same company under the same name so dont know how that works out

    ok it might be "mary's fashions" over the door but the company name might have changed(but same people) as would the trading name. If these are different(but the same business and same people) she would be entitled to redundancy from the previous company however she would not be entitled to any job from the new company never mind her previous.

    however that said its pretty low to do what they are doing imo
