    1.8 Having determined that the relevant markets reviewed are not effectively competitive,
    ComReg is now designating eircom with SMP, in accordance with Regulation 27 (4)
    of the Framework Regulations. This document also contains the final decision
    instrument setting out the SMP obligations to be imposed on eircom as a consequence
    of the SMP designation. The final decision instrument is set out as an Annex to this
    document and the SMP obligations therein are effective, from the date of publication.

    Surely it was evident years ago that the market is not competitive?
