Sherlock Murder

So just being rewatching Sherlock episode one. John doesn't know the cabbie had a gun, fake or not. All he saw was Sherlock and the driver about to pop the pills and he shoots him. He also had no idea what the cabbies MO was so he didn't know what the pills were all about. Thats murder in my eyes or am i missing something ?
