    Hi, just looking for advice. We're looking at a site being sold with full planning granted. Was initially granted when the area was A3 greenbelt and has a residency clause. The land has subsequently been re-zoned and is now open for residential development. We've queried with the planning office and have been told it would need a full reapplication to get rid of the clause. I find this a bit hard to believe as its obviously no longer applicable. Is there a way to show this clause is no longer applicable?! Possibly a letter from the council? Any help appreciated.

    The advice is correct to get rid of the residency clause. You could try sending a letter to the Director of Services for Planning querying whether they would be willing to give you a letter saying it no longer applies and the Council would not be enforcing that condition but the answer may well say no.
