No claims bonus - question

    NO Claims bonus issue

    son had a minor Accident rear ended car in front no damage to either car woman passenger very aggressive to son at time.. he reported crash to guards and his insurance company Kenco last feb .. has heard nothing back from either Insurance or individual involved … Policy up for renewal now
    Kenco has increased and NO Claims Bonus now zero as claim pending

    Quick question can son now get insurance from any other insurance providers
    with claim pending which he will mention or is he tied to kenco now

    No, not with a NC discount. And he'd have to declare an accident as well. Best to stay with your existing insurer. NC bonus protection is an idea for future.

    If claim not paid then he should get refunded the excess. But, that doesn't seem likely considering he rear ended someone and will take months, possibly years.

    We have been told claim has to be processed in two years under civil liability law the 3rd party has a period of two years to notify claim or it is closed
    just find it very strange 3rd party has made no contact in nearly 9 months with son or kenco
    sorry forgot to Add if he wished to change insurance companies can Kenco stop him leaving ?

    No, they can't legally prevent another company writing him a policy. But they know it won't happen unless he makes a false declaration - by omitting the potential claim in the proposal form. If he wants to continue driving with insurance, he is a captive customer until that claim is settled or dropped or the time expires.

    A 3rd party has up to 2 years to signify their intention to claim for injury. (much longer for damage to property) It could be that she has had her repairs sorted by her own insurers and they will seek recovery down the line.

    Most insurers will close their file around the 1st anniversary of the incident, providing there has been no contact from the 3rd party. They will re-open it in the future if anything develops.
