Hi all,
Vanilla are planning an update to the site on April 24th (next Wednesday). It is a major PHP8 update which is expected to boost performance across the site. The site will be down from 7pm and it is expected to take about an hour to complete. We appreciate your patience during the update.

Management company trouble

    Staying on a second floor apt mgt company giving hassle about having a sky dish want it removed ASAP.only found out by letter on Friday that they want it down. Said it shouldn't be there as per schedule six of our lease.our lease does not say we are not allowed dishes on exterior.nor does it have schedule 6.been here for 4yrs now and this was the reason we moved into where we are. Got a visit from them tonight saying that dish has to go. We want to keep it what grounds do we have considering 1. we don't have this in our lease and 2. We were given no notice. The alternative is get UPC but they are ****

    Pretty much every apartment block has rules against satellite dishes. These rules are the management complex contracts and not your lease. Your lease probably says you have to obey the terms of the management/block rules somewhere.

    Also, most blocks have these rules along with no displaying of e.g., towels over balconies and so on. Private tenant lease is for occupancy but not "modification of the exterior" which nailing a dish to would count as, IMO.
    With regard to UPC vs Sky, UPC wins hands down and has much better broadband service, provided you can get fibre optic digital services.

    What was the reason you moved into the apartments again?
    How long as the dish been up for?
    (Neither are that relevant to be honest)
    There is a lease you have with the landlord and an agreement the landlord has with the management company. You can see these at any time if you request them.

    If you think anything different you are looking at a legal challenge.

    The fact the dish was there was a factor in moving in.was up before we moved in and who knows how long before that. Mgt person said they it only came to light for them due to an oversight and she hadn't seen it.other residents had been given few months notice to remove theirs whereas we are expected to gave ours down in days.no way Jose

    The exterior walls (and balconies) are management company property and not your landlord's property so they are within their rights to insist you take them down.

    some turn ablind eye to dishes others do not. the lease the management company are refering to is the head lease, in other words the contract signed by the owner when they joined the company. I'm pretty certain that lease will also state that if a property is rented then the terms of the head lease also apply to the tenancy lease ie no dishes, loud music, hanging stuff outside, bikes in hallways, pets etc

    it could be a case your LL has not notified the company they have rented the property so the management company think they are talking to the owner when they refer to schedule 6 or what ever of the lease

    on a side not SKY offer communial solutions, its a small box attached to teh side of the propertie and allows a supply to each unit. that way owners have a choice of sky without the unsightly array dishes on the wall

    On a side note to this, a neighbouring development got communal dishes and overnight a flock of Lidl dishes appeared throughout the development from people deciding one dish meant dishes could go up. A lot of the people who put dishes up are non-Irish nationals seeking television stations from their home countries which are not available on Sky anyway. Hence, when Sky approached our directors, there was a unanimous no.

    Regarding the OP - there should be a clause in your lease that says you will comply with the development rules...which will include a no dishes policy. It is your landlord's responsibility to ensure that you are aware of these and they may have been negligent in not doing so. However, the letter you received indicates that dishes are not permitted and you have no right to dictate to the MC when they can enforce that rule, as already stated, balconies and external walls are MC property - you only have exclusive use.

    We didn't have that problem.

    We enforced the no sat dish policy in our development. We then brought in Sky and erected 3 Sky dishes to cover all 112 units.

    We didn't notice any new rise in other dishes, but still did see the odd one go up, but these units were then served with notice, and if they didn't remove them then the management agent had them removed and the units were charged an admin fee for that.

    As for the OP, you have no choice. Either you remove the dish, or the management agent will remove it. Then your landlord will get a bill for that which they may pass on to you.
