Divorce & Family Home

    Amicable separation - 5years ago
    2 parents and 2 dependent children both in education living in family home

    Ideally all parties can still remain in the family home as all bills are split equally. The house is big enough to accommodate all parties and a home for adult children whilst they pursue 3rd level education.

    Both parties want to agree to keep the family home as an investment - but divorce is now imminent as one party has moved on to a new relationship

    Questions are:
    1. Does a judge allow the keeping of the family home in Divorce or does the judge normally force the sale of family home once youngest turns 18/23?
    2. Once the divorce is through - does the 'Protection of Family Home Act' still apply ?

    if you come to a mediated agreement in advance, the judge will usually rubber stamp the agreement. and the service is free.
