Can I get paid.....without getting paid?

    Hi guys,
    I work as a specialist nurse and for a variety of reasons have just accepted a non-clinical job with a pharmaceutical company. As part of my contract with the Pharma company they have said they will allow me to remain clinically active (so I won't lose my specialist credentials by not practising) by working for an unrelated private medical clinic one day a week.

    The thing is, that my new employer (the Pharma company) has said in my contract that they will now allow me to receive payment from the private medical clinic for the days I work there. The Pharma company will continue to pay me and I can be paid expenses from the private medical clinic but not receive payment from the private medical clinic for the one day of work I do there each week.

    In other words the private medical clinic will essentially be getting me for free one day a week, other than paying me expenses. Is there another way that I can ask to get compensated by the medical clinic (e.g. shares/other benefits/paying me a lump some as a bonus etc) that would not break the rules of my contract with the Pharma company?

    Are the pharma company paying you for the day you are working in the clinic?

    Yes, the Pharma company will pay me, but it is considerably less that I would normally be paid for a day on the clinic. This is why I am wondering if I could request some additional form of payment from the medical clinic that would be above board.

    Tell them you are happy to give up your credentials by not practicing in the Clinic, concentrate solely on your non clinical job in pharma.

    Am I understanding correctly?

    * Your employer has said "every Friday you can work at this specific clinic". You do not have a separate work contract with the clinic; you are effectively working at the clinic as some sort of consultant on behalf of the Pharma company.

    * The Pharma company are paying you for this work, but at a lower rate than your normal Monday - Thursday job. You can bill the Pharma company for any expenses incurred during this consulting.

    Is this it?

    The only thing I can think of is that they pay your clinical registration fee and/or any some training.

    Seems from the op’s reply that he/she is paid normal rate on Friday for pharma job, plus expenses from clinic, but he/she would be paid a higher rate if he/she worked directly for the clinic.

    Interesting.

    I think if I were the OP I would just be grateful the Pharma company are being decent and letting me work offsite so I can keep my credentials.

    If the clinic job pays that much more would you not just go work for them full-time? Or is it a case that their high "daily rate" is only paid for contract workers coming in to cover occasional days?

    i.e. you are getting a lower daily rate to work for the pharma company + clinic combined, but with the benefit of a steady, permanent, full-time job with a fixed salary?

    Can these expenses not cover the differnce, or are they actual expenses ?

    Is the difference worth it to risk the new job?

    I'm really surprised that the private clinic is willing to have you on-site under these arrangements: effectively you are there as a volunteer, not their employee. It surely raises questions about whether you'd be covered by their employer's liability insurance, etc.

    Assuming that's all covered, then whether you can be paid in some other way comes down to what your contract with the pharma company says: does it just say "no pay", or is it specific about no remuneration at all. You probably need proper legal advice, rather than boardsies opinions.
