Vanilla are planning an update to the site on April 24th (next Wednesday). It is a major PHP8 update which is expected to boost performance across the site. The site will be down from 7pm and it is expected to take about an hour to complete. We appreciate your patience during the update.

HAP fraud case for debate.

    my friend rented his house while he went travelling.
    Tenant A. has double citizenship, she was born in Bulgaria but lived 95% of her Life in Turkey
    Her husband is a Turkish national and has obtained a visa to live in Ireland, as the wife obtained a decent job in the IT sector.
    They own and rent properties in Turkey. (substantial evidence as they are quite proud about it and numerous emails to the Landlord were sent detailing this , mortgages are payed off)
    The HAP application is under Bulgarian identity. The HAP application was approved.

    Question 1)
    By accepting a HAP payment where the landlord knows it was not obtained in good faith (properties not declared) , is the Landlord complicit to Fraud?

    Tenants are quite confident about their HAP entitlement and they claim HAP have no way of knowing that they own property (Turkish government do not share that kind of info)

    If reported , HAP will not be getting back to the landlord with the outcome.(probably GDPR)

    Question 2)
    Should landlord submit the forms and all the documents required and receive the HAP payment?
    If the landlord refuses to fill out the forms....will it be considered discrimination under WRC?

    Threshold are on the tenants side, and claim that even though evidence exists of property ownership, the landlord is not expected to question tenant's eligibility.

    Landlord is complicit in fraud, I'd have no involvement in this if I was them and would absolutely report this to the social welfare dept to make sure they can't dupe another landlord.

    If the Bulgarian national has a good job in IT together with the earnings of the Turkish spouse how are they under the income limits for social housing. Hap is administered by each local authority in their own area but Limerick County Council have ultimate responsibility under shared services. Ring Limerick County Council hap head quarters and ask their advice. Don't mind Threshold, ask them to put their advice in writing. They are requesting the landlord to be complicit in fraud. The landlord is on notice of the tenants intention to commit fraud so cant use that as a defence.

    If they are reported, they'll probably stay in the house until evicted, rent free.

    If they are willing to defraud the HAP system, they are willing to defraud the property owner.
